Subsection (b)(1) adds getting to treatment as one of the circumstances underwhich a driver may use an occupational limited license. The driver's petitionmust now identify not only the employer but also the educational institution ortreatment facility. Subsection (d)(6) specifies that anyone who has been adjudicated delinquent,granted a consent decree or granted ARD for DUI may not be issued anoccupational limited license unless the suspension or revocation for thatconviction has been fully served. This provision also allows occupational limited licenses for those whoselicenses have been suspended for a first violation of 18 PA.C.S. 6308. Subsection (d)(8) specifies that anyone convicted of DUI must serve the entiresuspension or revocation before being eligible for an occupational limitedlicense. However, a person convicted under 3802 who does not have a prioroffense as defined in 3806(a) shall be eligible for an occupational limitedlicense after serving 60 days of the suspension according to subsection (d.1). Aperson convicted under 1547(b)(1)(ii) or 3804(e)(2)(ii), relating to an18-month suspension for a first-degree misdemeanor, shall be eligible for anoccupational limited license if the individual 1) is otherwise eligible forrestoration; 2) has served 12 months of the suspension; 3) has no more than oneprior offense as defined in 3806(b); 4) only operates a vehicle with anignition interlock system and 5) has certified that each vehicle owned by orregistered to the person has been equipped with an ignition interlock system. Aperiod of ignition interlock accepted under subsection (d.2) shall not counttowards the one-year mandatory period of ignition interlock imposed under 3805. Subsection (f) specifies that an occupational limited license can only be usedbetween the driver's residence and place of employment or study or in the courseof employment or study where the operation of a vehicle is required. Theoccupational limited license can also be used to and from a scheduled oremergency medical examination or treatment, including treatment required underChapter 38. The operating privilege of a driver with an occupational limitedlicense remains under suspension or revocation except when the driver is withinthe conditions of the limited license. A driver must have a completedoccupational limited license affidavit at all times while operating a vehicle,except when operating a vehicle to a location for emergency medical treatment. Subsection (f)(2) specifies that a driver with an occupational limited licensemay not operate a school bus. Subsection (c) raises the fee for applying for an occupational limited licensefrom $25 to $50. Subsection (f)(3) establishes a summary offense and a $200 finefor violating the conditions of the occupational limited license. CVU Members Speak On DUII At Pioneer Pacific College CVU Members Speak On DUII At Pioneer Pacific College CRIME VICTIMS UNITED On February 1, 2004, CVU and MADD members Marie Armstrong and Anne Pratt spoke to a criminal justice class at Pioneer Pacific College in Springfield, Oregon. The topic was Driving Under the Influence of Intoxicants and its impact. Marie Armstrong's son Chance was killed by a drunk driver in 1996. Chance's girlfriend survived with a brain stem injury. The driver was sentenced to 90 days in jail for criminally negligent homicide. Released from jail, he drove with a revoked license, continued to drink and drive and violated other terms of his release including being a felon in possession of a firearm. Anne Pratt's son, Brian Hood, was killed by a drunk driver in 1998. Her experience with the criminal justice system led her and her husband Bruce to work for changes to Oregon's laws on DUII. Their efforts contributed to several bills passed by the legislature, most notably Brian's Bill , which increased penalties for criminally negligent homicide. Marie and Anne spoke about the impact of drunk drivers on their lives and the lives of other Oregonians, and their experiences with the criminal justice system. Pioneer Pacific student Jami Clark, who arranged for Marie and Anne to present to instructor Shan Weggland's class, wrote a note of thanks: February 3, 2004 Dear Anne and Marie: Thank you for making time to attend my class and be our guest speakers. I know that your presence has done two things: help you to speak about your pain and educate others so they too are not victims. It was very admirable for you to share such a painful experience with a room full of strangers. The power point was very informative and provided information that was not common knowledge. The pictures of your sons also made the situation a reality and not just a name in the obituary. The pictures helped to place a face with a name. In addition, seeing the copies of the Bills that were passed also helped us with the larger picture. I am in awe of your courage and your strength to continue to move forward and fight for stricter punishments and your hopefulness in the prevention you stand behind. I certainly agree that this knowledge needs to be shared with all counties of Oregon and perhaps nation wide. Knowledge is power and a lot of people do not have the knowledge. Keep your heads held up high and your passion growing, for this will be a tough road to travel. I would like for you to remember the following when things become tougher than normal. "A single drop of water begins a waterfall, and look what comes from that." ~Power of One~ You may be a single drop of water now; however, soon other drops will follow. A: Unfortunately, Alabama does not have what are sometimes known as “ work licenses ”. If you lose your license you cannot drive for any reason. That’s why it’s important to fight the DUI charge aggressively . Q: Do I have to take the Breath Test? A: Yes. In Alabama we have what is known as the ' Implied Consent Law .' That means that if you operate a motor vehicle in the State of Alabama you automatically consent to giving a breath test if specifically requested to do so by a Police Officer. Q: What happens if I refuse to take a breath test? A: Under Alabama’s implied consent law, if you refuse to take the breath test after being asked to do so by a Police Officer, your license will suspended for 90 days, in addition to any time that it is suspended for the DUI conviction. Q: How can I “beat” a DUI charge? A: Actually, there are many ways to “ attack ” a DUI or Refusal charge. The first is to challenge the “ stop ” of your motor vehicle. To do this your attorney must thoroughly examine the details of the circumstances surrounding the “stop” of your car to determine whether the police officer followed all “ constitutional guidelines ” as set forth in the United States (federal) and Alabama (state) Constitutions and all “ case law ” or prior cases similar to your particular case. Next, your attorney should examine what “ observations ” the police officer made of you at the scene of the traffic stop. Did he smell the odor of alcohol? Did he note that your eyes were bloodshot and watery? Did you perform the Standardized Field Sobriety Test okay? Then, if you submitted to a breath test, your attorney must thoroughly examine the police paperwork or “ Discovery ” to see if the Breathalyzer was working properly, if the police officer operating the machine was certified to do so, and if he/she operated the machine appropriately when you blew into it. These are only some of the many ways to challenge a DUI charge. Q: Should I retain an attorney for my DUI charge? A: Yes. Due to the severe penalties you are facing and the numerous and complicated laws relating to motor vehicles and DUI charges you should always retain an attorney. If you don’t, it will be very difficult and almost impossible to beat a DUI charge. The attorney should be experienced DUI law. Again, this is because laws relating to a DUI charge are many and are complicated. An experienced and knowledgeable attorney can present both legal and factual arguments to the court to help you win your case!
