Who We Are: We both feel fortunate that other people have recognized us for being good at what we do. Here is some information about our backgrounds and accomplishments: Geoffrey Burg • “Super Lawyer” recipient by peers in Washington Law & Politics Magazine . • Speaker and chair of seminars regarding DUI defense. • Writer of numerous articles . • In July 2002, I discovered a problem with the breath-testing machine - the "caretakers" ( Washington State Patrol Breath Test Technicians ) of the machine were not following all the rules for calibrating it. I successfully litigated this issue and was able to suppress thousands of breath tests around the state. As reported on the front page of the Seattle Post-Intelligencer , and other periodicals around this State, this meant that for my clients, as well as other people who fell under the time period when the instrument was not being properly calibrated, if the breath test showed a reading above a .08 BAC, then it would be kept out of evidence and no judge or jury would ever learn of the result if the DUI went to trial. • Legislative Liaison for the Washington Association of Criminal Defense Lawyers. In this role I wrote, lobbied for and passed three laws that help people accused Washington State DUI. (Photo: Geoffrey Burg at the right, present for the signing of HB 1589.) • Graduate of Gerry Spence’s Trial Lawyers College. Mr. Spence is one of the best known trial attorneys in the world and he chooses 48 people a year to come live with him on his ranch in Wyoming for 21 days to train as a trial lawyer. I was fortunate enough to have been chosen to attend this program and completed it in 2001. Photo: Geoffrey Burg with Governor Gregoire. • Member of the only two Washington State DUI organizations that you must be voted into the Washington Foundation for Criminal Justice and the Northwest Academy of DUI Defense. Combined, these two organizations have under 25 members of people considered of the highest caliber of representing those accused of Washington State DUIs. Most importantly, I have had great success in helping people accused of DUI. My rate of having people found not guilty at trial is higher than the state average. In addition, I pride myself (and gauge how well I am doing) by the number of thank you notes I receive from my clients. I feel proud in saying that I regularly receive these. Patricia Fulton • I devote my practice to defending clients accused of crimes, especially DUIs. I am very proud of the reputation as a thoughtful and articulate advocate I have earned while defending people accused of DUI in Washington. • Named a “Rising Star” by Washington Law and Politics Magazine. • Member, and past President of the Northwest Academy of DUI Defense a Washington State DUI Defense organization with exclusive, by invitation only, membership. • Speaker/Presenter at DUI related seminars. • Author of articles regarding DUI Defense. • Membership of numerous criminal defense and trial organizations, including the Washington Association of Criminal Defense Lawyers. • Member of the King County Bar Association and member of the King County Bar Association’s Lawyer Referral Oversight Committee. • Admitted Washington State Bar and Federal District Court, Western Washington Division . Tammy LaLanne: As our paralegal, Tammy keeps us organized and on time. She is the person who greets you on the phone and helps with many of the details of your case. While we try and speak to you in person when you call, if we are in court, Tammy is the one that will make sure your questions are answered. • Graduated from Paralegal School • Working with attorney’s since 1989. We have designed this web site to try and answer every Washington DUI question that you may have. We did this because we know that knowledge is power and we wanted to give you back some of the power that you may feel you have lost from your arrest. We would like the opportunity to meet with you and discuss your Washington DUI related case. Please give us a call or email us so that we can begin to help you resolve your case. P.S. this is the disclaimer that our insurance carriers probably want us to make: Disclaimer: The legal system is complicated and people often find it has as many twists and turns as a maze. This is certainly true with Washington State DUI work. It is for these reasons that the information contained in this site is not legal advice and does not substitute for speaking with us, or any other Washington State DUI attorney out there about the particulars of your Washington State DUI charge. Each Washington State DUI charge really is unique and really does require individualized attention through a face-to-face consultation. The pages in this web site contain a lot of information, but just reading it does not make one an experienced attorney. Washington DUI law is very complicated and heavily litigated and there is a lot more information out there than can be put on just one web site, or probably even learned in a lifetime for that matter. Please, only make decisions about your case based on the personal advice of a lawyer. Mannie Garcia / Reuters Did Gonzales (right) get Bush off a DUI jury duty? By By Michael Isikoff Newsweek Jan. 31 issue - Senate Democrats put off a vote on White House counsel Alberto Gonzales's nomination to be attorney general, complaining he had provided evasive answers to questions about torture and the mistreatment of prisoners. But Gonzales's most surprising answer may have come on a different subject: his role in helping President Bush escape jury duty in a drunken-driving case involving a dancer at an Austin strip club in 1996. The judge and other lawyers in the case last week disputed a written account of the matter provided by Gonzales to the Senate Judiciary Committee. "It's a complete misrepresentation," said David Wahlberg, lawyer for the dancer, about Gonzales's account. Bush's summons to serve as a juror in the drunken-driving case was, in retrospect, a fateful moment in his political career: by getting excused from jury duty he was able to avoid questions that would have required him to disclose his own 1976 arrest and conviction for driving under the influence of alcohol (DUI) in Kennebunkport, Maine-an incident that didn't become public until the closing days of the 2000 campaign. (Bush, who had publicly declared his willingness to serve, had left blank on his jury questionnaire whether he had ever been "accused" in a criminal case.) Asked by Sen. Patrick Leahy to describe "in detail" the only court appearance he ever made on behalf of Bush, Gonzales-who was then chief counsel to the Texas governor-wrote that he had accompanied Bush the day he went to court "prepared to serve on a jury." While there, Gonzales wrote, he "observed" the defense lawyer make a motion to strike Bush from the jury panel "to which the prosecutor did not object." Asked by the judge whether he had "any views on this," Gonzales recalled, he said he did not. MOST-POPULAR ARTICLES Are You Working Yourself to Death? While Gonzales's account tracks with the official court transcript, it leaves out a key part of what happened that day, according to Travis County Judge David Crain. In separate interviews, Crain-along with Wahlberg and prosecutor John Lastovica-told NEWSWEEK that, before the case began, Gonzales asked to have an off-the-record conference in the judge's chambers. Gonzales then asked Crain to "consider" striking Bush from the jury, making the novel "conflict of interest" argument that the Texas governor might one day be asked to pardon the defendant (who worked at an Austin nightclub called Sugar's), the judge said. "He [Gonzales] raised the issue," Crain said. Crain said he found Gonzales's argument surprising, since it was "extremely unlikely" that a drunken-driving conviction would ever lead to a pardon petition to Bush. But "out of deference" to the governor, Crain said, the other lawyers went along. Wahlberg said he agreed to make the motion striking Bush because he didn't want the hard-line governor on his jury anyway. But there was little doubt among the participants as to what was going on. "In public, they were making a big show of how he was prepared to serve," said Crain. "In the back room, they were trying to get him off." Gonzales last week refused to waver. "Judge Gonzales has no recollection of requesting a meeting in chambers," a senior White House official said, adding that while Gonzales did recall that Bush's potential conflict was "discussed," he never "requested" that Bush be excused. "His answer to the Senate's question is accurate," the official said. 2006 Newsweek, Inc. Print this Email this MORE FROM NEWSWEEK PERISCOPE Newsweek Periscope Section Front . A person is guilty of drunk driving when he or she drives or is in actual physical control of a motor vehicle and is under the influence of alcoholic beverages or any chemical or controlled substance to the extent that his or her mental faculties are impaired or when his or her blood alcohol level (BAC) is above the legal limit for the state. Depending on what state in which you are charged, drunk driving offenses can also be known as any of the following: DUBAL - Driving with an Unlawful Blood Alcohol Level DUI - Driving Under the Influence DUII - Driving Under the Influence of an Intoxicant DUIL - Driving Under the Influence of Liquor DWAI - Driving While Ability Impaired DWI - abbreviation could be interpreted as Driving While Intoxicated or Driving While Impaired, depending on the state in which you were arrested DWUI - Driving While Under the Influence OMVI - Operating a Motor Vehicle While Intoxicated OUI - Operating Under the Influence OUIL - Operating a Vehicle Under the Influence of Liquor OUIN - Operating Under the Influence of Narcotics OWI - Operating While Intoxicated OWVI - Operating While Visibly Impaired UBAL - Unlawful Blood Alcohol Level If a person drinks while boating, he or she could potentially be charged with Boating While Intoxicated ( BWI ), which carries similar consequences as driving offenses involving land-borne vehicles like a car, truck or motorcycle. All offenses that involve the operation of a vehicle (whether the vehicle is land-borne or water-borne) while intoxicated are criminal law matters, which could potentially incur a felony conviction and possibly a prison sentence, depending on how serious the charges are. Whether you are charged with a misdemeanor or felony offense, you should contact a drunk driving defense attorney immediately if you are arrested. Implied Consent Implied consent laws are the rights and responsibilities of drivers holding a state-issued drivers license. In particular, there is an implied consent to a blood, breath, or urine test for BAC. Violations of implied consent laws typically lead to automatic (administrative or court-ordered) suspension of driving privileges. For more information, consult a DUI lawyer . New "Per Se" Offense Has Been Enacted In recent years, all 50 states and the District of Columbia have enacted a second, "per se", offense: driving with an excessive blood-alcohol concentration (typically .08%). BOTH offenses are charged, and you can even be convicted of both. But the driver under influence can only be punished for one. Open Container Law In addition to drunk driving defense laws, most states also have an "open container law," which is the offense of having an "open container" of alcohol within the driver or passenger compartment of your vehicle. Open container laws prohibit the possession of any open alcoholic beverage container and the consumption of any alcoholic beverage within the driver and/or passenger area of a motor vehicle. Contact a drunk driving defense attorney for information on the open container law in your state. DMV Administrative Actions In addition to the criminal drunk driving charges brought against you, your state's department of motor vehicles can also take administrative action against you if you are arrested for drunk driving. Use the form on this page to find a LawInfo Lead Counsel qualified drunk driving defense attorney in your area for more information about these actions and what you may be able to do to avoid these form happening. Administrative License Sanctions: This term refers to any sanctions legally imposed by state agencies without first requiring court orders . The exact scope, procedures, and limitations of administrative license sanction programs vary among states. In general, they are used to provide rapid, consistent treatment of offenders against the state's drunk driving defense laws or its DUI , DWS, DWR, and DWU laws. Typical administrative sanctions include license suspension, mandatory evaluation or treatment, fees, and education. DWS, DWR, and DWU: Driving While Suspended (DWS), Driving While Revoked (DWS) and Driving While unlicensed (DWU) denote the citation (a moving violation) and/or the license status of the driver at the time of a crash or other event. Administrative Per Se: This term describes the laws establishing an administrative process for dealing with violations of the maximum allowable blood alcohol content (BAC) for drunk drivers in a state. States with administrative per se laws also have a set of procedures in place for suspending the driving privileges of a person who violates the BAC limit without the need for a court trial—that is, the responsible state agency can suspend a driver for a BAC violation even if the court does not convict him or her on the corresponding drunk driving offense. Your drunk driving defense attorney can explain the drunk driving defense laws regarding Administrative Per Se to you in more de tail.. Ignition Interlock: This is a device that renders a car inoperative unless one or more preconditions are met. In drunk driving de fence driver-control programs, the typical ignition interlock device requires the driver to give a breath sample which is then analyzed for the presence of alcohol. If there is alcohol present (above some minimum threshold value), the car will not start. Other variations are used to ensure that the drunk driver does not operate the vehicle, or is the only driver of a vehicle. Should I hire a drunk driving defense attorney? Because drunk driving laws are complex, you not only need to hire a lawyer , but one who specifically specializes in drunk driving defense . DUI lawyers know that some of the enforcement and judicial procedures are unconstitutional and violate motorists' rights. They are more well versed with the different sobriety tests and their varying accuracy levels. Don't give up your rights.
