For drivers with three or more prior Operating While Intoxicated (OWI) convictions, the limit is lower: they cannot operate a motor vehicle if their BAC is greater than 0.02 Drivers under 21 years of age are required by law to maintain "absolute sobriety," and, for them, driving with any amount of alcohol in their system is illegal. A driver is "under the influence" when his or her ability to operate a motor vehicle is impaired. A person's ability to operate a motor vehicle is impaired if he or she is less able to safely control the vehicle because of the consumption of alcohol or controlled substances. This means that if a police officer pulls you over and determines that you are impaired by alcohol and/or any other drug, you could be arrested and prosecuted, regardless of your BAC. Penalties for operating a motor vehicle while intoxicated range from a forfeiture and license revocation for a first offense, to up to 6 years imprisonment, 3 year license revocation and possible seizure of vehicles for subsequent offenses. Additionally, more severe penalties apply if injury or death results. But no matter what your legal status, it is always wise to avoid driving if you have been drinking. A recent review of alcohol impairment studies by the National Highway Traffic Safety Administration (NHTSA) concluded that impairment of some driving-related skills begins with even the smallest amount of alcohol in your system. The following tables allow you to estimate the Blood Alcohol Concentration (BAC) you would reach when drinking over a variety of time periods. Because BAC varies with body weight, number of drinks, the sex of the drinker, and the time over which drinks are consumed, each of these pieces of information is necessary for the calculation. One drink is defined as having one-half ounce of pure ethyl alcohol; each of the following is considered "one drink." *10 ox to 12 oz of beer at 4% to 5% alcohol, or *8 oz to 12 oz of wine cooler at 4% to 6% alcohol, or *4 oz to 5 oz of table wine at 9% to 12% alcohol, or *2.5 oz of fortified wine at 20% alcohol, or *1.25 oz of 80 proof distilled spirits at 40%alcohol, or *1 oz of 100 proof distilled spirits at 50% alcohol. Devices like the Alcosensor III and IV use fuel cells. The fuel cell has two platinum electrodes with a porous acid-electrolyte material sandwiched between them. As the exhaled air from the suspect flows past one side of the fuel cell, the platinum oxidizes any alcohol in the air to produce acetic acid, protons and electrons. Oxidation of Alcohol If you strip off hydrogens from the right carbon of ethanol in the presence of oxygen, you get acetic acid , the main component in vinegar . The molecular structure of acetic acid looks like this: O || H 3 C - C - O - H where C is carbon, H is hydrogen, O is oxygen, the hyphen is a single chemical bond between the atoms and the || symbol is a double bond between the atoms. For clarity, the bonds of the three hydrogen atoms to the left carbon atom are not shown. When ethanol is oxidized to acetic acid, two protons and two electrons are also produced. The electrons flow through a wire from the platinum electrode. The wire is connected to an electrical-current meter and to the platinum electrode on the other side. The protons move through the lower portion of the fuel cell and combine with oxygen and the electrons on the other side to form water. The more alcohol that becomes oxidized, the greater the electrical current . A microprocessor measures the electrical current and calculates the BAC. Operators of any breath alcohol testing device must be trained in the use and calibration of the device, especially if the results are to be used as evidence in DWI trials . Law enforcement officers can carry portable breath testing devices that use the same principle as full-size devices. Court cases can turn on the perceived accuracy of a breath test, however, so prosecutors rely on the results obtained from full-size devices. A San Diego firm of DUI defense attorneys reports that breathalyzers used by law enforcement do not actually measure alcohol -- and thus may produce falsely high "blood alcohol" readings. According to the the Law Offices of Lawrence Taylor, Inc., in San Diego, California, most breathalyzers used in DUI cases by law enforcement today use "infrared spectroscopy". This technology involves detection of the "methyl group" in the molecular structure of alcohol. The problem is that there are thousands of chemical compounds containing the methyl group -- some of them found on the human breath. In one study involving 28 subjects, for example, researchers found that the "combined expired air comprises at least 102 various organic compounds of endogenous and exogenous origin" ("Characterization of Human Expired Air", 15 Journal of Chromatographic Sciences 240). If a person has any of these other compounds on his breath, called "interferents" by the engineers, he will get a falsely high blood-alcohol test result. And if there are two or more such compounds on his breath, the machine will add them up and falsely report the total as the blood-alcohol level. So what compounds can be found on your breath? According to the San Diego DUI attorneys, diabetics with low blood sugar can have high levels of acetone -- which is "seen" as alcohol by Breathalyzers. And scientific studies have found that people on diets can have reduced blood-sugar levels, causing acetone hundreds of times higher than found in normal individuals (Frank and Flores, "The Likelihood of Acetone Interference in Breath Alcohol Measurements", 3 Alcohol, Drugs and Driving 1). And there are many other so-called "interferents" affecting breathalyzer results If you are a smoker, your breathalyzer result is likely to be higher than expected. The compound acetaldehyde -- containing the methyl group and so reported by the Breathalyzer as "alcohol" -- is produced in the human body as a by-product in metabolizing consumed alcohol, and eventually passes into the lungs and breath. Researchers have discovered that levels of acetaldehyde in the lungs can be 30 times higher in smokers than in non-smokers. Result: higher BAC readings on the machine. The San Diego DUI lawyers report that common household products, such as paint, glue, gasoline, and thinners also contain the methyl group. No, you dont have to drink the stuff: simply absorbing it through your skin or inhaling the fumes can result in significant levels of the chemical in your body for hours or even days, depending upon the "half-life" of the compound. So if youve painted a room or breathed in fumes at a gas station in the last day or two, don't take a breathalyzer test. If you are stopped by the police and suspected of drunk driving, say the San Diego DUI lawyers, you might consider a blood test rather than submitting to a breathalyzer.
