DUII Forfeiture Program A DUII Story DUII Forfeiture Program Lincoln County Home Page County Counsel Home Page Sheriff's Home Page Reed College Study Establishes Effectiveness of DUII Forfeiture Programs Oregonian Article About Lincoln County DUII Forfeiture Program In 1994, the Lincoln County Board of Commissioners enacted Ordinance # 335 (codified as LCC 2.3000 and 2.3005 ), which was followed by companion city ordinances from the cities of Siletz (Ordinance # 150 adopted October 25, 1994) Depoe Bay (Ordinance # 210 adopted November 8, 1994), Waldport (Ordinance # 617 adopted November 10, 1994), and Yachats (Ordinance # 169 adopted November 10, 1994). The Ordinance generally provides that a vehicle is subject to seizure and possible forfeiture if it is being driven by a person who is under the influence of intoxicants (DUII) and the person has at least one prior DUII the previous 10 years. The Lincoln County Sheriff's Office is charged with enforcement of the Ordinance, and the Office of Lincoln County Legal Counsel processes those seizures. The program generally works like this: (1) If a person is arrested for DUII by the Sheriff's Office, and the person does not have a prior DUII within the previous 10 years, their vehicle is impounded in accordance with state law. The owner of the car can reclaim it upon payment of a $100 administrative fee, plus the costs of towing and storage. (2) If a person is arrested for DUII by the Sheriff's Office, and the person has one prior DUII within the previous 10 years, their vehicle is seized in accordance with ordinance and state law. The person is eligible for administrative release of their vehicle upon signing a release agreement and payment of a $250 administrative fee, plus the costs of towing and storage. (3) If a person is arrested for DUII by the Sheriff's Office, and they have two or more prior DUII's within the previous 10 years, their vehicle is seized and forfeited in accordance with ordinance and state law. Since August 5, 1994 (the date the Ordinance went into effect), there have been 138 seizures (categories (2) and (3) above), of which 75 were administratively released, 57 were forfeited, and 6 are currently pending. Once a vehicle has been forfeited, it is either auctioned , sold to a licensed wrecker, or sold through the State's surplus property program. DUII Diversion JOSEPHINE COUNTY COURTS 14th Judicial District TO THE PERSON CHARGED WITH DRIVING WHILE UNDER THE INFLUENCE OF INTOXICANTS IN JOSEPHINE COUNTY You have been charged with the traffic crime of Driving While Under the Influence of Intoxicants. The offense is punishable by a Maximum sentence of one year in jail and a fine of up to $5000 or both. Upon conviction, you will also lose your drivers license for one or three years depending on your driving record. If you have not been convicted of DUII or have not participated in the diversio program as the result of such a charge within ten years before the date of this incident, and if this incident did not involve an accident resulting in an injury to another person, you may be eligible for the diversion program. THE DIVERSION PROGRAM To enter the diversion program you must pay a filing fee of $405.00 to the Court. You are required to pay $40 to the Court when filing the petition. The balance may be paid in monthly payments. You will also be required to pay a $25 fee when attending the required Victim Panel. You will be required to undergo an evaluation, at your expense, to determine the existence and extent of any alcohol or drug problem. The additional cost of evaluation is $90 plus a $35 administration fee which must be paid at the time of evaluation. THE COST OF TREATMENT IS TO BE PAID BY YOU. This additional treatment program cost must be paid or be waived by the treatment agency. If you complete the treatment program, and meet all the other conditions of the diversion, the charge of DUII will be dismissed after the prescribed time. Your Motor Vehicle Division Driving Record will show the rehabilitation program. If you do not complete the program as required, including the payment of all court fees and treatment fees or you use intoxicants in conjunction with the operation of a motor vehicle during the diversion period, you will be prosecuted for this DUII. If you are interested in the diversion program or wish to think about it, you may be granted additional time. You are required to reappear at the time scheduled by the court. You may also obtain a petition to enter the diversion program and sworn statement of eligibility from the court. Except for lines 7, 8 & 9, the petition should be completed by you and submitted to the court. Gloria James, 37, of suburban Green, was pulled over shortly before midnight on Friday by two off-duty officers, Akron Police spokesman Lt. Rick Edwards said Saturday. They were working security for the Akron Metropolitan Housing Authority in an unmarked car when they spotted James, who was alone in the 2004 Cadillac Escalade, he said. The officers say James' car "almost hit" their car, Edwards said. "She starts weaving in and out of traffic and passing people on the right," he said. The officers said James smelled of alcohol and she appeared to be disoriented, Edwards said. She struggled with police as they attempted to put handcuffs on her. They put her in the back seat of the housing authority car where she yelled obscenities at the officers, Edwards said. "She kept leaning forward, screaming, hollering and carrying on," he said. The officers put her in a police cruiser when it arrived on the scene, Edwards said. James kicked a window of that car, knocking it off track without breaking the glass, he said. Edwards said the officers pulled her out of the cruiser after she kicked the window and made her wait on the ground until a patrol wagon arrived. James was taken to a police station, where she refused to take breath or sobriety tests and refused to answer questions, Edwards said. She posted a $2,500 bond and was released. She was charged with reckless operation, speeding for driving 50 mph in a 30-mph zone, operating a vehicle while intoxicated, disorderly conduct and damaging police equipment, Edwards said. She is scheduled to appear in Akron Municipal Court on Monday afternoon. LeBron James, in Salt Lake City for a game against the Utah Jazz, declined to comment Saturday night. "I don't have all the info of what's going on," he said. "Once I find that out and once I sit down with my family, you know, I'll be able to comment on it a little bit better."
