Nov. 29 2005 10:38 AM ET CTV.ca News Staff Pocket breathalyzers are not always accurate and could give drivers a false sense that they're sober enough to get behind the wheel, say traffic safety groups. The devices, sold for about $10 under names such as the Alcohol Tester, are available at stores across Canada such as the Bay, Wal-Mart and Zellers. They operate much the way a roadside alcohol test does: a driver blows into the mouthpiece and if their blood alcohol level is above the legal limit of .08 per cent, a red light is ignited. Andrew Murie, the CEO of MADD (Mothers Against Drunk Driving), says his group does not endorse the devices because they often give inaccurate readings. "Basically, the reliability of the equipment for false negatives is really high," he told Canada AM Tuesday. "And so it's like playing Russian roulette with your safety and others on the roadway." Murie says his biggest worry about the devices is that drivers will get inaccurate results from them and will continue to drink beyond the legal limit. "Then you get behind the car and you cause carnage out there that is unnecessary. So the public shouldn't rely on this really cheap type of -- it's really a gizmo," he says. The price of the tiny devices alone should raise eyebrows, Murie says, since the equipment that police officers use cost thousands of dollars, require extensive training to use and have to be tested and recalibrated regularly. Murie says he's not just disappointed in the device's accuracy; he says that drivers shouldn't be using them at all. "It sends the wrong message. You should never drink up to the legal limit," he says. "If you're going to drink, separate it from the driving." But the Bay says the pocket breathalyzer has been very popular and has become a hot seller. "Given the popularity of the product, consumers are clearly demonstrating they're engaging with the worthwhile message MADD is spreading about responsible drinking," says corporate communications director Hillary Stauth. One of the manufacturers of the devices, Resource Management International, has also defended its Connectables Breathalyzer tester. "We do not condone drinking and driving," the company said in a recent statement. "The Connectables Breathalyzer allows consumers access to a reliable and affordable alcohol-testing device that can take the guesswork about whether it is safe to drive. It is designed to create awareness and responsibility." Curie adds that he believes that the legal limit in this country is far too high. That's why MADD is now lobbying the government to lower the legal blood-alcohol limit to .05 per cent, though he concedes that their efforts have stalled now that the country is into a federal election. "But we still believe and the public should believe that the guideline of .05 and lower is where you should be. Because intoxication starts at the first drink and as low as .03." California's DUI Punishment Laws - First Drunk Driving Offence DUI Laws Punishment First DUI Second DUI Third DUI Enhancement Negligent Operator First DUI Offense California Vehicle Code §23536 If any person is convicted of a first violation of Section 23152 , that person shall be punished by imprisonment in the county jail for not less than 96 hours, at least 48 hours of which shall be continuous, nor more than six months and by a fine of not less than three hundred ninety dollars ($390), nor more than one thousand dollars ($1,000). The court shall order that any person punished under subdivision (a), who is to be punished by imprisonment in the county jail, be imprisoned on days other than days of regular employment of the person, as determined by the court. If the court determines that 48 hours of continuous imprisonment would interfere with the person' s work schedule, the court shall allow the person to serve the imprisonment whenever the person is normally scheduled for time off from work. The court may make this determination based upon a representation from the defendant's attorney or upon an affidavit or testimony from the defendant. Except as provided in paragraph (2) of subdivision (a) of Section 23538 , the person's privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to paragraph (1) of subdivision (a) of Section 13352. The court shall require the person to surrender the driver's license to the court in accordance with Section 13550 . California Vehicle Code §23538 Conditions of Probation for First Time Offense Except as provided in subdivision (d), if the court grants probation to any person punished under Section 23536 , in addition to the provisions of Section 23600 and any other terms and conditions imposed by the court, the court shall impose as a condition of probation that the person be subject to one of the following: Be confined in the county jail for at least 48 hours but not more than six months, and pay a fine of at least three hundred ninety dollars ($390), but not more than one thousand dollars ($1,000). Except as provided in paragraph (2), the person's privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to paragraph (1) of subdivision (a) of Section 13352 . The court shall require the person to surrender the driver's license to the court in accordance with Section 13550 . Pay a fine of at least three hundred ninety dollars ($390) but not more than one thousand dollars ($1,000), and, if the person gives proof of financial responsibility, as defined in Section 16430 , to the Department of Motor Vehicles , have the privilege to operate a motor vehicle restricted for 90 days to necessary travel to and from that person's place of employment and to and from participation in a program described in subdivision (b). If driving a motor vehicle is necessary to perform the duties of the person's employment, the restriction also shall allow the person to drive to locations within the person's scope of employment. Whenever the driving privilege is restricted pursuant to this paragraph, the person shall maintain proof of financial responsibility for three years. If the court elects to order a 90-day restriction as provided for in paragraph (2), the court shall order and advise the person of the following matters: If the person's privilege to operate a motor vehicle is suspended under Section 13353.2 , the court-ordered restriction does not allow the person to operate a motor vehicle unless the suspension under Section 13353.2 has either been served to completion or set aside, and his or her license has been reinstated. The restriction of the driver's license described in paragraph (2) shall commence upon the reinstatement of the privilege to operate a motor vehicle. If a suspension was not imposed pursuant to Section 13353.2, the person shall be advised by the court that the person's driving privilege may be suspended by the department pursuant to subdivision (c) of Section 13352.4 until proof of financial responsibility is provided. (b) In any county where the board of supervisors has approved, and the State Department of Alcohol and Drug Programs has licensed, a program or programs described in Section 11837.3 of the Health and Safety Code , the court shall also impose as a condition of probation that the driver shall enroll and participate in, and successfully complete a driving-under-the-influence program, licensed pursuant to Section 11836 of the Health and Safety Code, in the driver's county of residence or employment, as designated by the court. The court shall refer a first offender whose blood-alcohol concentration was less than 0.20 percent, by weight, to participate for at least three months or longer, as ordered by the court, in a licensed program that consists of at least 30 hours of program activities, including those education, group counseling, and individual interview sessions described in Chapter 9 (commencing with Section 11836) of Part 2 of Division 10.5 of the Health and Safety Code. The court shall refer a first offender whose blood-alcohol concentration was 0.20 percent or more, by weight, or who refused to take a chemical test, to participate for at least six months or longer, as ordered by the court, in a licensed program that consists of at least 45 hours of program activities, including those education, group counseling, and individual interview sessions described in Chapter 9 (commencing with Section 11836) of Part 2 of Division 10.5 of the Health and Safety Code. The court shall advise the person at the time of sentencing that the driving privilege shall not be restored until the person has provided proof satisfactory to the Department of Motor Vehicles of successful completion of a driving-under-the-influence program licensed pursuant to Section 11836 of the Health and Safety Code. The court shall revoke the person's probation pursuant to Section 23602 , except for good cause shown, for the failure to enroll in, participate in, or complete a program specified in subdivision (b). The court, in establishing reporting requirements, shall consult with the county alcohol program administrator. The county alcohol program administrator shall coordinate the reporting requirements with the department and with the State Department of Alcohol and Drug Programs . That reporting shall ensure that all persons who, after being ordered to attend and complete a program, may be identified for either failure to enroll in, or failure to successfully complete, the program, or successful completion of the program as ordered. Notwithstanding subdivision (a), if the offense occurred in a vehicle requiring a driver with a class A or class B driver's license or with an endorsement specified in Section 15278 , the court shall upon conviction order the department to suspend the driver's privilege pursuant to paragraph (1) of subdivision (a) of Section 13352 . Driver's blood-alcohol level triple limit By Joe Gerrety and Sophia Voravong The man accused of causing a Chicago-area car crash Sunday that killed two West Lafayette children had a blood-alcohol content three times the legal limit, according to the Cook County State's Attorney's office. Ralph Pollock, 46, of Schaumburg, Ill., faces preliminary charges of reckless homicide and aggravated driving under the influence of alcohol, Tandra Simonton, a spokeswoman with the state's attorney's office, said. A judge in Maywood, Ill., set Pollock's bond Tuesday morning at $1 million. Formal charges are expected to be filed at a preliminary hearing Aug. 10. Police in Franklin Park, Ill., said Pollock was driving a full-size pickup truck when he ran a red light about 6:36 p.m. Sunday near O'Hare International Airport, striking a minivan carrying Greg and Sherry Hockerman of West Lafayette and their three children. The minivan burst into flames. Claire Hockerman, 14, and her brother, Nathan, 5, were killed. Their brother, Paul, 11, and his parents all suffered burns. The family was returning home from a vacation in Switzerland. "They are working on feeling better. That's the main focus right now," Guy Hockerman, the children's uncle, said via cell phone on Tuesday from Loyola University Medical Center in Maywood, Ill., where Greg, Sherry and Paul are being treated. It's unknown when they will be released. "We're dealing with things one at a time. That's all we can do," he said. "Their (physical) conditions incredibly have changed from what it was before. They're making progress." Guy Hockerman declined to comment on the preliminary charges against Pollock, who had a previous misdemeanor conviction for drunken driving in 1998, Simonton said Cook County court records show. Instead, the family is focusing on recovery, Hockerman said. Several family members and friends from the Lafayette area also are in Chicago, providing a strong support network. "Greg and Sherry both are aware that there's a larger community ... who've expressed their love and concern and they're appreciative of that," Hockerman said. West Lafayette's Maple Ridge Community Church, where the Hockermans attend, held a prayer service Monday night for the family. Friend Cyndi Renicker, administrative assistant at the church, said parishioners will continue to offer their prayers as the family mends physically and emotionally.
