It is one of the most frequently committed violent crimes in the United States. In their mind, these messages are directed at "Drunk Drivers" not at them. To them Drunk equals behavior that is out of control or noticeably impaired, and when they drive after consuming alcoholic beverages, they consider themselves "buzzed" not drunk. The goal of these PSAs is to get people to begin to talk about and recognize the dangers of "buzzed" driving. Subsequently, this campaign's objective is to get people to stop driving buzzed. When you have been investigated or arrested for any criminal offense such as Driving While Intoxicated (DWI) , or any Felony Charge, you have an absolute right to be concerned. Facing criminal charges may be one of the most frightening things you have encountered. Some of the possible consequences that can result from a Driving While Intoxicated (DWI) conviction include the restriction or loss of a driver’s license, an increase in insurance costs, fines, court costs, and even the possibility of jail. As you can see, Driving While Intoxicated (DWI) can be a very serious charge. The law says that the County Attorney needs only to prove that after drinking you were not able to drive your car in a “normal” capacity. That sounds pretty cut and dried, but it is not quite as simple as that. You see, if challenged, the County Attorney must also show all of the following: • That the arresting officer made the arrest properly, • That you were properly advised of your rights, • That the equipment the officer used to test you was working accurately, and • Even that the person operating the equipment was certified to operate the equipment. Further, the officer that administers the “standard field sobriety tests ” should have successfully completed the National Highway Traffic Safety Administration Standardized Field Sobriety Testing student class before administering these tests. I have successfully completed training for the National Highway Traffic Safety Administration Standardized Field Sobriety Testing. What does that mean to you? It means that in addition to grading you on your performance of the tests, I will also grade the officer to ensure that he or she conducted the tests properly. If the tests were not conducted properly, this can be disclosed to the County Attorney or the jury to show that the tests results were unreliable and should not be believed. When you retain me I’ll insist that the County Attorney provide us with the names and address of anyone he plans to call as a witness as well as copies of every written or recorded statements of their testimony. This will allow us to prepare our questions of them. I’ll insist that the County Attorney provide us with any information or material he has which would show that you are not guilty of the charges against you, or which may help you get a lighter sentence. I’ll insist on receiving copies of any videos that show your sobriety tests, whether in the field or at the station. I’ll insist on receiving copies of records showing that the equipment used for tests was functioning properly and that the person giving the tests was properly certified. Intoxicated Driving

Driving While Intoxicated Driving While Intoxicated Persons driving while intoxicated (DWI) pose a threat to the entire community. In 2003, the Criminal Court Bureau continued its collaboration with other government agencies such as the NYPD and the New York City Department of Transportation (DOT) to obtain convictions in DWI cases. This year, 645 individuals were arrested in the Bronx and charged with offenses involving driving under the influence of alcohol or drugs. Twenty-five of these individuals were indicted on felony DWI charges. (A person can only be charged with the felony if he or she is currently charged with DWI or driving while impaired by drugs, and has a prior conviction within the past 10 years for one of these offenses.) In 2003, a total of 646 misdemeanor DWI cases were disposed. The Office obtained convictions in 95% of these cases. The bureau continued to work with the DOT in the state-funded Stop DWI Program, which operates throughout New York City. The program is dedicated to fighting drunk driving through public education and also assists law enforcement with monetary, technical, legislative and legal support. As part of its comprehensive involvement in DWI issues, the Office sent a representative to present DWI prosecution issues at five New York Prosecutors Training Institute (NYPTI) events attended by a total of about 300 assistant district attorneys and police officers from throughout New York State. In addition, a representative of the Office chaired a NYPTI committee which produced a New York State guide to vehicular homicide prosecutions. The guide was then disseminated to every District Attorney's office in the state and to many police agencies. The bureau participates in the New York City Department of Transportation's Stop DWI Criminal Justice Task Force, a group with representatives from each District Attorney's office and the NYPD, to coordinate citywide DWI prosecutions. The Office also coordinated an extensive training of all New York City Police Collision Investigators in the latest collision reconstruction methodologies. The Office also used DOT community service programs and referred some DWI offenders for treatment in Bronx Lebanon Hospital's Stop DWI Program. Contact us « Drugs are Like That PSA | Main | Jets stadium grounded » Judges toss out DUIs because breathalyzers' source code is secret Via Boing Boing , we learn: "Florida judges are tossing out DUI cases when defendants ask to see the source code for the breathalyzers that busted them -- the manufacturers won't turn over the source, and since the machine's correct operation is critical to establishing the case against the DUIers, the case is dismissed when it can't be produced." All four of Seminole County's criminal judges have been using a standard that if a DUI defendant asks for a key piece of information about how the machine works - its software source code, for instance - and the state cannot provide it, the breath test is rejected, the Orlando Sentinel reported Wednesday ... Now if only they could find a way to apply this to voting machines . All are probably covered by proprietary code. We are either going to have a lot more disclosure or far fewer convictions. This ruling appears likely to create too much havoc; I can't imagine that the appeals courts will let it stand. After all if you push enough with a speeding ticket and go through the trouble to make sure the radar is been certified and the cop is certified to use it etc... and it turns out it is not you can walk away with out the ticket or a fine. I find this quite interesting, too many things in life go through with out checks and balances, I say more power to someone if they take this route. Although shame on that person for drinking and driving and causing a serious problem, but we all know most of the time a DUI is all about timing and has little to do with being loaded. I think the decision is the right one, but the havoc it will cause will keep courts from embracing the theory more broadly. To balance the constitutional rights of the defendants against the business interests of trade secret holders, courts will start issuing confidentiality orders and compelling disclosure of the code to the defendant.
