We all agree that drunk driving is bad...but what happens when our DUI laws reach the point where hundreds of thousands of American citizens are being criminalized each year for "drunk driving" even though they were not impaired at the time of their arrests? What happens when our laws reach the point where eating yeast bread or a pack of M&Ms can produce an Intoxilizer reading that results in a citizen being arrested for DUI? Despite what MADD propaganda would have you believe, in 1996 only .0000143 percent of the American population was killed in so-called "alcohol related" motor vehicle accidents where someone had a blood alcohol content as high as 0.10% . Government statistics indicate that each year more people die as a result of accidental drowning in America than die in low BAC related motor vehicle accidents. A recent study at a major U.S. university found that low BAC drinking drivers pose far less danger to public safety than do non-drinking drivers who have sleep apnea. In fact, your chances of being killed as a direct result of medical malpractice is 28 times higher than your chances of being killed in a motor vehicle accident involving a low BAC driver. Despite the extremely low statistical threat to public safety posed by low BAC drinking drivers, more than 600,000 low BAC drivers are arrested and convicted for "drunk driving" in America each year. Once arrested these otherwise law-abiding citizens are subjected to imprisonment; forced to pay huge fines and court costs; forced to pay the costs of probation; suffer unjust property forfeitures; forced to attend political re-education camps; subjected to psychological testing; forced to engage in involuntary forced labor; suffer government sponsored public humiliation; suffer the loss of driving privileges; suffer loss of respect for the courts and their government; suffer the loss of their jobs; their self esteem; and the destruction of their families. All lawyers are not equal, and some will try to con you. Some lawyers have reputations for always pleading their clients out. This type of lawyer is a non-threat to prosecutors. Beware of the following sales pitch from this type of lawyer: SCENARIO: This is your first DUI in Phoenix Municipal Court. You blew a 0.099 on the Intoxilyzer 5000. You are charged with DUI with a BAC of 0.080 or higher, and DUI while impaired to the slightest degree. SALES PITCH FROM LAWYER WHO WILL TAKE YOUR MONEY AND SELL YOU OUT : "I can get you a deal. I will get the prosecutor to drop one of the DUI charges in exchange for you pleading guilty to the other. You will only have to do one day in Sheriff Joe's 'Tent City'." ANALYSIS : Tell that lawyer thanks for nothing. The reality is, this hypothetical client would likely be offered that exact deal with or without a lawyer. Such a "deal" (which by the way is no deal at all) requires NO work whatsoever on the attorney's part, other than showing up to court. Depending on how the case plays out, this may be the best deal the prosecutor will offer without going to trial (keep in mind that it is against the law for prosecutors to plea bargain DUIs without a good reason)... however, an attorney who tries to sell you this "deal" at the initial meeting is one to look out for. An attorney who will never take them to trial and make them prove their case is not a threat. If the lawyer is more interested in your money than in winning, best to let somebody else be his/her sucker. Beware of the overextended lawyer. If an attorney has too many DUI cases without the firm resources to back them up, they will not be able to do a good job on all of their cases. How do lawyers get overextended? It's not from being too good. The good ones get plenty of referrals, and simply raise their rates rather than taking more clients. The ones to watch out for are the ones with rock bottom fees, who are forced to take massive numbers of cases because some phone book salesperson or TV advertising rep talked them into buying tens of thousands of dollars of monthly advertising. A lawyer with a single full-page ad in a large metro- area telephone book will have to gross an estimated extra $60,000.00 in fees just to pay for the ad. A lawyer with just one 3-page ad in the large Metro yellow page book will pay upwards of $18,000.00 per month for that ad (and that's just yellow and black, no color). Then they have to pay the extra staff that it takes to screen the hundreds of extra monthly phone calls, pay for computers, telephones and space for that staff. Then, on top of that, they have to take in even more clients to make a profit on that one ad. You get the idea. Be careful of paying lawyers for their saturation marketing rather than their skill, expertise, and attention. You want an attorney to whom you are more than just a number. Ask your lawyer several questions to determine his/her method, motivation and style of practice: a) What percentage of your cases are DUIs? It is literally a full-time job keeping up with current DUI law and science, and serving DUI clients in a professional, complete and conscientious manner. Ideally, the attorney you select should devote 95% or greater of his/her time to defending impaired driving charges. At a minimum, the DUI defense lawyer should spend at least half of his/her time on DUIs. An attorney who does personal injury, divorce, bankruptcy, wills and DUI (although probably a good attorney and a good person) is not going to serve all of his/her clients well all of the time. Even a full time criminal defense lawyer who defends all kinds of crimes may not be able to turn over every stone in your DUI case. The law is too vast and complex for one person to conquer all areas. b) What percentage of your DUI (and other criminal cases) cases plead guilty to a non-reduced charge? Keep in mind that you don't necessarily need an attorney to plead guilty as charged. Some so-called DUI defense lawyers plead 100% of their DUI clients out, without so much as a reduction to a lesser charge or a break in sentencing. THE LA CONGA LINE: A Spoof PICTURE THIS... a jubilant lawyer, slicked out in an expensive suit strolls into court with 7 private clients on the docket. The first client puts her hands on the lawyer's hips from behind. The next client lines up behind the first client, and puts his hands on her hips. This continues until all 7 clients are in line behind the lawyer. The lawyer then dances towards the judge and prosecutor to the beat of an Afro-Cuban rhythm. Just like the Conga dance, the clients in turn march towards the judge... "da da ta ta ta ta... GUILTY" "da da ta ta ta ta GUILTY." c) How many DUI cases have you handled in the last couple of years? The law changes constantly. Although a lawyer may have handled thousands of cases years ago, it is their most recent experience that assures they are tune with the law, the courts and the prosecutors. Beware of the lawyer you have to dust off. d) What DUI specific training do you have? Some have been prosecutors. Some cops. Some have undergone training in alcohol science or field testing. Some have simply read a book. Some regularly network and strategize with other dedicated DUI lawyers through forums like the National College for DUI Defense and various other groups, while others do nothing. e) What kind of stamina and support staff do you have? This question, while in the past irrelevant, is becoming increasingly important in Arizona DUI cases. A new court rule says that all DUI cases must either conclude by a plea bargain or go to trial within 6 months from their start date. This didn't use to be the case. Your attorney must now have the energy and resources to litigate your case in a compressed time-frame. Arizona DUI Attorneys ' Fee Range and Structures: Lawyers who defend DUI cases charge a wide range of fees, in a variety of structures. Because there is such a large range, it may be helpful to interview several lawyers with various fee ranges to discern their differences. The rules of ethics governing lawyer conduct prohibit lawyers from representing clients on a contingent fee basis in DUI cases. Therefore, no competent DUI lawyer will enter into an agreement where the client pays only if the lawyer wins. Other than that limitation, you will find a wide range of fees structures and billing practices among DUI defense attorneys. The most common fee structure is the flat fee. Under this arrangement, the client pays a predetermined amount up-front. This covers the entire matter, no matter how much work it requires, and no matter if it goes to trial or is settled without litigation. A variation of this structure splits the flat fee into several phases. For instances, an attorney may charge a flat fee for everything up until a jury trial, and then charge an additional fee if the case proceeds to a trial. For a first time misdemeanor Arizona DUI charge, expect fees from $3,000.00 to $15,000.00. For felony DUIs, expect fees from $15,000.00 to upwards of $25,000.00, plus the costs and expert witness fees. Other lawyers will charge an hourly rate, say $350.00 per hour . They will ask for an initial retainer up front, and then bill against that retainer as the work is done. When the original retainer is exhausted, they then ask the client to replenish it with new money. Some lawyers are willing to accept payment plans or adjust their fees to accommodate a client's financial need. Others ask for the entire fee up front or in a couple large payments. There are no rules governing this area, and the lawyer is free to offer whatever payment structure he/she deems best. D.W.I.Untitled Document Contents The DWI Detection Guide Explanations of the 24 driving cues Summary A description of post-stop cues thatare predictive of DWI Introduction More than a million people have died in traffic crashes in the UnitedStates since 1966, the year of the National Traffic and Motor Vehicle SafetyAct, which led to the creation of the National Highway Traffic Safety Administration,or NHTSA. During the late 1960s and early 1970s more than 50,000 people lost theirlives each year on our nation's streets, roads and highways. Traffic safetyhas improved considerably since that time: the annual death toll has declinedsubstantially, even though the numbers of drivers, vehicles, and miles drivenall have increased. When miles traveled are considered, the likelihood ofbeing killed in traffic during the 1960s was three to four times what itis today. The proportion of all crashes in which alcohol is involved also has declined.The declines in crash risk and the numbers of alcohol-involved crashes areattributable to several factors, including the effectiveness of public informationand education programs, traffic safety legislation, a general aging of thepopulation, and law enforcement effort. NHTSA research contributed to the improved condition, in part, by providingpatrol officers with useful and scientifically valid information concerningthe behaviors that are most predictive of impairment. Continued enforcementof DWI laws will be a key to saving lives in the future. For this reason,NHTSA sponsored research leading to the development of a new DWI detectionguide and training materials, including a new training video. Many thingshave changed since 1979, but like the original training materials, the newdetection guide describes a set of behaviors that can be used by officersto detect motorists who are likely to be driving while impaired. Building upon the previous NHTSA study, the researchers interviewed officersfrom across the United States and developed a list of more than 100 drivingcues that have been found to predict blood alcohol concentrations, or BACs,of 0.08 percent or greater. The list was reduced to 24 cues during threefield studies involving hundreds of officers and more than 12,000 enforcementstops. The driving behaviors identified by the officers are presented inthe following four categories: 1) Problems in maintaining proper lane position, 2 ) Speed and braking problems, 3) Vigilance problems, and 4) Judgment problems. The cues presented in these categories predict that a driver is DWI atleast 35 percent of the time. For example, if you observe a driver to beweaving or weaving across lane lines, the probability of DWI is more than.50, or 50 percent. However, if you observe either of the weaving cues andany other cue listed in this booklet, the probability of DWI jumps to atleast .65, or 65 percent. Observing any two cues other than weaving indicatesa probability of DWI of at least 50 percent, although some cues, such asswerving, accelerating for no reason, and driving on other than the designatedroadway, have single-cue probabilities greater than 70 percent. Generally,the probability of DWI increases substantially when a driver exhibits morethan one of the cues. The research suggests that these training materials will be helpful toofficers in: Detecting impaired motorists, Articulating observed behaviors on arrest reports, and Supporting officers' expert testimony.
