Senate Bill 421 - Increases Consequences For Intoxicated Drivers Who Kill Senate Bill 421 - Brian's Bill Increases Consequences For Intoxicated Drivers Who Kill CRIME VICTIMS UNITED CVU Members Spearhead DUII Legislation On September 25, 2003, Oregon Governor Ted Kulongoski signed Brian's Bill into law. Senate Bill 421 increases sentences for criminally negligent homicide caused by an intoxicated driver. It raises the presumptive sentence in such DUII ("driving under the influence of intoxicants") cases from 18 to 36 months. Crime Victims United members Anne and Bruce Pratt spearheaded the legislative campaign for Brian's Bill, named after their son Brian Hood, who was killed in a reckless DUII homicide in 1998. The Pratts received help from other CVU members, from other victims of DUII crimes, and from legislators. Representative Randy Miller and his legislative aide, Dawn Phillips, provided strong support for the Pratts' effort which started during the 2001 legislature. It was part of a package of DUII-related bills for which the Pratts took a leadership or supporting role: House Bill 2900 calls for fines of up to $1,000 for refusing to take a breathalyzer test when arrested for DUII. Senate Bill 302 requires that people charged with DUII for the first time plead guilty before they can enter a "diversion" program through which they can have the DUII conviction expunged. House Bill 2885 permanently revokes the license of drivers convicted of DUII three times (not including the diversion) in a ten-year period. The package has been called the most significant DUII legislation in Oregon in a decade and has revitalized awareness of the consequences of DUII. Sometimes, accidents, tickets, and drunk-driving convictions can escape your insurer's attention or don't end up on your motor vehicle record. However, if your insurer does find out about a driving under the influence (DUI) conviction, you're likely to feel the pinch of higher rates and possibly policy cancellation or nonrenewal. There are two ways insurance companies generally deal with customers convicted of DUI. First, your insurer will likely raise your insurance premiums and label you a high-risk driver if it finds out you've been convicted of DUI. In this case, you'll likely have to file proof of insurance for three — sometimes five — years with your state's department of motor vehicles. Your insurance company will have to provide the DMV with an SR-22 form, which removes your license suspension by providing the state with proof of insurance. An SR-22 also means your insurance company is required to notify the DMV if it cancels your insurance for any reason. Your auto insurer will likely raise your premiums, and it might cancel your policy if you've been convicted of DUI. Most state laws require DUI convicts to get an SR-22 from their insurers, so you can't hide. In addition, your company may cancel your insurance mid-term or terminate the policy at the end of the term because of your DUI conviction, especially if you are currently in a preferred class. Your company will send you a notice stating why you've been canceled, and then you'll have to find another insurer while having a cancellation on your claims history. Some insurance companies don't offer SR-22 policies, so you may also be nonrenewed or canceled because your company can no longer provide what you need. Certain states don't allow insurance companies to drop you in the middle of the policy term even for a DUI, so make sure you know the laws in your state. Insurers can miss DUI convictions It's possible that your insurance company will never find out about your conviction if you don't have to get an SR-22. A June 2002 study by the Insurance Research Council revealed that as many as one-quarter of driving convictions never end up on motor vehicle records, due to lack of shared information between courts and motor vehicle departments or because a conviction has been erased through alternative means, such as driving school. If you get your charge reduced in a plea bargain, or have a limited license suspension, such as 30 days, it's also very unlikely your insurer will find out about your conviction. In most states, an insurance company has three years after a DUI to cancel you or raise your rates. If your insurance company misses the conviction at the time it happens, it has three years, according to most state laws, to cancel your policy or raise your rates because of the DUI. Rates don't always go up You may be surprised to know that when your insurer does find out about a DUI conviction it doesn't automatically impose higher premiums. The insurer will look at your history with the company and your claims record, and your fate is in its hands. For example, State Farm's action depends on which subsidiary you're with. If you have a preferred policy with State Farm Mutual Insurance Co. and receive a DUI, State Farm may move you into State Farm Fire & Casualty, which is the standard-policy company. If you're moved from preferred to a standard status, you'll be paying higher rates already. State Farm will also review your motor vehicle and insurance claims history to determine if it needs to raise your rates further. WHAT YOU SHOULD KNOW ABOUT THE INTOXICATED DRIVER RESOURCE CENTER PROGRAM Intoxicated Driving Program Division of Addiction Services HOW DOES THE PROGRAM APPLY TO ME? If you have been convicted of an alcohol or drug-related traffic or boating offense in New Jersey, you must satisfy the requirements of the intoxicated Driving Program (IDP) and the Intoxicated Driver Center (IDRC). These programs have two purposes: (1) to make our highways and waterways safer by educating drivers and boat operators about alcohol, drugs and their relation to motor vehicle and boating safety, and (2) to identify and treat those who need treatment for an alcohol or drug problem. WHAT PROGRAM MUST I ATTEND, AND WHERE IS IT? If you are sentenced as a first offender, you will be detained, educated, and evaluated for at least six hours each day on two consecutive days -- a total of 12 hours - in your county IDRC. If you are sentenced as a second offender and not sentenced to jail or inpatient treatment, you will be detained, educated and evaluated during a period of 48 consecutive hours in a regional facility. If you are sentenced as a third offender, the court may sentence you to jail or to an inpatient alcoholism treatment program or both. IDP will schedule you to appear at the 12-hour IDRC for follow up. You may be required to participate in additional treatment or self help. In all cases you must satisfy the program, fee and treatment requirements of IDP/IDRC before your license is restored. IF I DON'T LIVE IN NEW JERSEY, MUST I STILL COMPLY? Yes. The driving privilege restoration and IDP fees ($150) still must be paid to Motor Vehicle Services. If you live within driving distance of an IDRC in New Jersey, you will be scheduled to appear there. If not you will be given an opportunity to satisfy the requirements in your home state. WHAT IF I DON'T PARTICIPATE? If you fail to appear at the IDRC or do not satisfactorily complete a prescribed treatment or self-help program, or pay the fees on time, your license suspension will be extended or reimposed, and you may also be jailed two days for noncompliance. IDP/IDRC program completion will still be required. WHAT HAPPENS AT THE IDRC? You will pay the IDRC program fee and complete a questionnaire. You will attend a series of educational sessions and discussions. You will meet with a counselor for a personal evaluative interview. WHAT DOES THE EDUCATION PROGRAM DO? The education program, which is part of the 12- and 48- hour IDRC, contains information on social and problem drinking, stages of alcoholism, the family and other relationships, alcohol and drugs and their effects on driving ability, and the New Jersey Intoxicated Driving Law. WHAT HAPPENS AFTER I HAVE BEEN DETAINED AND EVALUATED? You may be referred to a treatment program or self help group for alcohol or drug problems. If you are referred to treatment, it will be for a minimum of 16 weeks. The IDRC may require monitored treatment or self-help group attendance for a maximum of one year. You must complete treatment as part of your sentence. WHAT ABOUT MY DRIVER'S LICENSE? Your driving privilege will be restored when you have satisfied all court- and DMV- imposed suspensions and if you are in compliance with all Intoxicated Driver Resource Center requirements. WHAT IS IDP/IDRC? The Intoxicated Driving Program is a unit of the Division of Addiction Services of the New Jersey Department of Health and Senior Services. The IDRCs are units of, or contractors to, the 21 counties. IDP schedules you for the 12- or 48-Hour IDRC program and notifies Motor Vehicle Services (MVS) when you have completed or failed to comply. IDP staff work with the IDRCs to insure that you are treated fairly under the law. HOW MUCH DOES IT COST? Please see summary of offenses below. If you are referred to a treatment program you are also responsible for those costs.
