Program Description STOP-DWI stands for "Special Traffic Options Program for Driving While Intoxicated". The STOP-DWI Program was enacted by the State Legislature in 1981 for the purposes of empowering county governments to coordinate local efforts to reduce alcohol and other drug-related traffic crashes within the context of a comprehensive and financially self-sustaining alcohol and highway safety program. Funding STOP-DWI funding is limited to enhancement programs which reduce the incidence of drunk driving and is supported entirely by the fines paid by people convicted of driving while intoxicated. STOP DWI funding is limited to enhancement programs, which reduce the incidence of drunk driving. Application of DWI fine revenues and fund balance covers the fiscal year program expenses at no cost to local taxpayers. Broome County STOP DWI - A Success Story Drunken driving fatalities have decreased by 86% since 1981. The number of people injured in alcohol-related crashes has decreased by 53% since 1981. Single vehicle nighttime personal injury and fatal crashes have decreased by 58%. "Weekend" nighttime personal injury and fatal accidents have decreased by 51%. Drivers age 20 and under have decreased their involvement in alcohol-related crashes by 65% since 1981. Law Enforcement Funds the STOP DWI Task Force Program with Binghamton, Johnson city, Endicott and Vestal Police agencies that features the specially marked, highly visible STOP DWI patrol cars. Funds special DWI patrols with the Broome County sheriff's Office, Deposit Police and Port Dickinson Police. Purchase radar equipment and accident reconstruction supplies for the New York State Police. Sponsors specialized training programs for police officers. Funds a video program in which DWI offenders are videotaped at the scene of arrest and at police station. Prosecution Funds Assistant District Attorney to specialize in DWI prosecution. Supports the Crime Victims Assistance Program's DWI Victim Impact Panel that requires DWI offenders to go before victims of DWI cases to listen to their stories and learn of the tragedies that result from drunk driving. Public Information and Education Funds specialized education programs for enforcement, prosecution, and education and treatment professionals who deal with various aspects f the drunk driving issue. Funds a comprehensive print, billboard, radio and television promotion campaign. Coordinates SADD (Students Against Destructive Decisions) activities in Broome County. Provides and/or coordinates speakers, films, assemblies, displays and printed materials to schools and other organizations. Sponsors special events, using the popularity of sports to promote the STOP DWI message to youth and the community. Danielle 5K Run/Walk - 1st Sunday of May. STOP DWI Tournament of Champions - Girls fastpitch Softball Tournament held in mid July. Chris Thater memorial - Last weekend of August. International cycling, running and in-line skating event. STOP DWI Holiday Classic - December 27-29 each year. National invitational high school boys basketball tournament. Conduct TIPS (Training for Intervention Procedures) training which is an alcohol training awareness program. It is designed to teach acceptable standards of practice for serving alcohol at concessions and on premises. Probation Funds a Senior Probation Officer to supervise DWI cases and sponsors in-service training opportunities. Funds an on-going recidivism study, which reveals a very low rearrest rate for DWI Probationers. Supports an in-house random drug-testing program for DWI Probationers. Administration Work with the STOP DWI advisory board, local officials and public and private community groups to develop a comprehensive DWI counter measure program in Broome County. Monitor and evaluate traffic accident data to assess the effectiveness of Broome County's STOP DWI effort. Seek private/corporate sponsorship to help finance law enforcement and education/promotional programs. Other Achievements Since 1991, STOP DWI has won twelve Binghamton Ad Club Genesis Awards for its print and television ad campaigns to prevent DWI. In 1995 and 1999 a STOP DWI commercial won first place in the New York State Broadcasters Association Public Service Announcements division. Received a 1995 Project Price Award from the Broome County Chamber of Commerce. Danielle Stento 5K Run/Walk has raised over $200,000 since the event began in 1992 to benefit local organizations that deal with the DWI issue. STOP DWI Holiday Classic rated one of the top high school boys basketball tournaments in the United States. Recognized as the outstanding alcohol education/prevention program in New York State 1994. Chris Thater Memorial, held in memory of DWI victim, is one of North America's top pro cycling events. The event also includes a national caliber 5K Run and In-line skating. Recognized as the outstanding alcohol education/prevention program in New York in 2001. STOP DWI Coordinator received the Honorable Senator William T. Smith Award in 1994 for his contribution to the STOP DWI effort in New York State. STOP DWI Coordinator received the Community Service Award by the New York State Athletic Administrators Association in 1997 for his work with substance abuse and athletics. STOP DWI Coordinator received the 2001 Liberty Bell Award by the Broome County Bar Association for his contribution to the criminal justice system. Your Driver License & the Department of Motor Vehicles The following information about DUI and your driver license rights in Arizona was provided by a Tucson attorney, David Alan Darby . If you find yourself arrested for Driving Under the Influence of Alcohol (DUI) in the State of Arizona, and you have submitted to a breath, blood, or urine test, and the results of the test reveal a blood/breath alcohol result of .08% or higher, or you have refused these tests, you can expect to be involved in two separate legal proceedings. A criminal proceeding in court A civil proceeding with the Department of Motor Vehicles (MVD) and the likely suspension of your driver license. These two proceedings are mutually exclusive; the outcome of one will not affect the other. You could win both matters or lose both matters. How the MVD driver license hearing is handled is extremely important. The Criminal Proceeding Your DUI arrest begins your criminal proceeding. The consequences of this -- plea of guilty, or a verdict of guilty following a jury or bench trial -- could result in mandatory jail time, fines, fees and assessments, supervised or unsupervised probation, as well as a criminal record. The Civil Proceeding The civil proceeding is conducted before an administrative hearing officer at the MVD. This proceeding deals with a possible suspension of your driver's license, or if from out of state, your privilege to drive in Arizona. The arresting police officer will serve you with a "Notice of Suspension." If you have been arrested in Arizona for DUI and you take a breath, blood or urine test, and the results measured a alcohol concentration of .08% or more within 2 hours of driving, or you refuse to take the blood, breath or other chemical test, the arresting police will serve you with a 90 day driver license suspension notice, or in the case of refusal, a 12 month driver license or driving privilege suspension. The police should give you two copies of this form. Arizona Residents If your test results indicate a result of .08% or higher, the police will seize your Arizona driver license, and issue you a temporary license which is valid for 15 days, or, if you request a hearing within the 15 day window, until the hearing is conducted and the outcome determined. Since the police confiscated your driver license, the yellow copy of the suspension notice is your temporary driver license. Non-Arizona Residents If you are from out of state, the police cannot seize your driver license. They will serve you with a notice of suspension of your privilege to drive in Arizona. The suspension will take effect 15 days after service unless you request a hearing within the 15 days. If a hearing is requested, your privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined. Refusal If you refused to take the breath, blood or urine test, the police will serve you a notice of a 12-month suspension of your driver license, or privilege to drive if you are from out of state. This suspension becomes effective 15 days from the date of service unless you request a hearing. If a hearing is requested your driver license or privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined. If your refused to take a breath, blood or urine test, it is likely that the police obtained a search warrant and obtained your blood anyway. If this is the case, your driver license or privilege to drive will still be suspended for 12 months even though the police obtained your blood through the use of a search warrant. How to Request A Hearing A request for hearing must be submitted in writing to the MVD. Generally, the pink copy of suspension form, furnished by the police, is used to request this hearing. It is important to fill out the information completely and accurately on the back of the pink form. You must check the box indicating you are requesting an Administrative Hearing and mail it, within 15 days of service to you by the police, to: Arizona Department of Transportation, Executive Hearing Office, Mail Drop 507M, P.O. Box 2100, Phoenix, AZ 85001-2100. Do not select Summary Review; this will not get you a hearing, but merely a review of the paperwork submitted by the police. Why Is This So Important In the criminal case, if you plead guilty to the charge of DUI, or if you are found guilty, you will be sentenced in accordance within the present Arizona DUI sentencing guidelines . When the State receives notification of the verdict, your driver license will be suspended for 90 days. However, if you are a first offender, or you have had no DUI convictions within the past five years, and if you took the breath, blood or other required test, and if you have been found guilty in the criminal proceeding, or you feel that such a result is likely, then you may wish to agree to a suspension of your driver license prior to or at the MVD hearing.
