Michigan Appellate Digest - 165941 People v Fish (On Remand) Michigan Appellate Digest People v Fish (On Remand) COA# 165941 Released: August 4, 1994 Published: November 18, 1994 Panel: MacKenzie, Gribbs, Dodge (PC) 207 Mich App 486; 525 NW2d 467 (1994), lv den 447 Mich 1004; 525 NW2d 462 (1994), vac'd 451 Mich 891; 549 NW2d 576, on rem 220 Mich App 569; 560 NW2d 76 (1996) Statutes - Constitutionality - Presumption Statutes are presumed to be constitutional, and will be construed as constitutional unless the contrary is clearly apparent. Crimes - OUIL - Third Offense - Constitutionality The statute establishing the felony of OUIL-third offense is constitutional. In this case, the defendant was charged with OUIL-third offense, but at the preliminary examination the district court dismissed the charge on the basis that the OUIL-third offense statute was unconstitutional. The circuit court properly reinstated the charge. MCL 257.625(6)(d) Crimes - OUIL - Third Offense - Elements - Prior Convictions Generally, a person convicted of operating a vehicle while under the influence of liquor is guilty of a misdemeanor, but if the violation occurred within ten years of two or more prior convictions, the person is guilty of a felony and must be sentenced to one to five years and a fine of $500 to $5,000. The offense of OUIL-third offense is a separate crime from OUIL. The prosecutor must establish each prior conviction beyond a reasonable doubt to prove OUIL-third offense. MCL 257.625(6)(d) Crimes - Enhancement - Elements - Prior Convictions When a statute establishes a separate crime rather than a procedure for sentence enhancement, the prosecutor must prove all elements of the offense, including the prior convictions. Statutes - Construction - Legislature - Knowledge of Existing Laws - Judicial Interpretation The Legislature is presumed to be aware of judicial interpretations of statutes, and the Legislature's silence on an issue construed suggests agreement with the judicial construction. Jurisdiction and Venue - Jurisdiction - Circuit Court - Misdemeanor/Felony Charge When a defendant is charged with both a felony and a misdemeanor, the circuit court has jurisdiction over the entire case. Preliminary Examination - Bindover - OUIL-Third - Elements - Prior Convictions - Out-of-State At a preliminary examination regarding a charge of OUIL-third offense, the prosecutor must comply with the rules of evidence and must prove the substantial correspondence between Michigan's drunk driving laws and any out-of-state prior convictions. MCL 257.625(6)(f), MCR 6.110(C), MRE 1101

Grey Monkey & Almost Librarian » Jury Duty Home | About | Archives | Links | Contact Grey Monkey & Almost Librarian The World of Bevill Tue 11 Oct 2005 Jury Duty Posted by site admin under General Last week I had jury duty… It was the first time I’d ever gotten called for jury duty in the last 10 years or so, and all previous times I got out of it for school. I actually showed up Monday and got picked for the trial Thursday morning. At first I thought there was no way I’d want a jury trial after hearing the people in the pool of prospective jurors, but after spending time with those people in the jury room I felt completely different. The actual trial was really short with only the police officer testifying, the video of the field sobriety test and the arrest. The lawyers doing their spin jobs, and the judge explaining the process and giving his instructions took the longest. The video that was shown was chopped, which led us to believe there was something they didn’t want us to see, which we then suspected were prior arrests. More on that later though. Other than the word of the police and the video, there wasn’t shit to go on as the defendant refused to take the breath/blood test and we were instructed that we couldn’t use that against him. Many of the things that were pointed out in the video such as him staggering, were in fact him rubbing out his cigarrete butt a few times. The smokers noticed that right away. Anyway we all thought there was more to the story that we weren’t being told, but it didn’t total up to being found guilty. When I got home the first thing I did was look up his arrest history that will show county and city arrests, and sure as shit this wasn’t his first incident. He had 3 previous arrests and two more after the fact. In all six he was booked for DUI, refusing to take the breath/blood test and for not having a licence. Part of the video that was cut was when he asked what’s going to happen to his license in the beginning which led us to think he was used to the process. -Grey Monkey One Response to “Jury Duty” Zerin Hood Says: October 17th, 2005 at 1:33 pm What was the officer’s testimony? How many beers did the defendant say that he had been drinking? Were there any passengers in the car? More importantly, what was the discussion in the jury room like?
