Then he was diagnosed with multiple sclerosis. Mr. Reimer uses marijuana daily to cope with the effects of his illness and intends to use an impaired driving charge to scrutinize the law's approach toward marijuana and its impacts on life. As Canada inches closer to softer marijuana laws, a retired Killaloe lawyer is asking the courts to rule on the murky issue of driving while under the influence of cannabis. Rick Reimer intends to use an impaired driving charge to scrutinize the wobbly approach of legislators toward the use of marijuana and its impacts on daily life. In a case that begins in a tiny courtroom tomorrow, he is both the accused and defender. Mr. Reimer, 47, a prominent criminal lawyer in Pembroke until his retirement two years ago, uses marijuana daily to cope with the effects of multiple sclerosis. He was diagnosed four years ago and, in November 2000, was granted a Health Canada exemption to use the drug for medicinal purposes. "I smoke marijuana constantly, from morning until night," said Mr. Reimer, estimating he smokes about 10 to 12 joints a day. On Feb. 11, he was pulled over on Highway 60 as he made his way toward Pembroke at about 11 a.m. on a clear, sunny morning that followed a fresh snowfall. He was stopped by an OPP officer near Round Lake Centre for allegedly weaving about the road. Mr. Reimer displayed some of the classic signs of impairment: slurred voice and unsteady gait. Those are precisely the symptoms of his disorder, he says. The smoking of marijuana, he argues, actually makes him a better driver. "There's no doubt whatsoever that I am not impaired in any way, shape or form by marijuana smoking, any more than a tobacco smoker would be," he said yesterday. One of the central issues in the trial promises to be the inability of police officers to assess precisely -- at the roadside or in the station -- the level of impairment caused by marijuana smoking. Unlike the test for alcohol, there is no quick and easy method to determine levels of THC in a driver's system. And unlike alcohol, THC, the active ingredient in marijuana, stays in the body for long periods. Mr. Reimer hopes to use the criminal trial to expose what he considers the government's hypocritical attitude toward the legal use of marijuana. The unusual court case comes the same week Justice Minister Martin Cauchon said he intends to proceed with legislation, likely to be introduced by April, that would decriminalize the possession of small amounts of marijuana. "If Cauchon comes down with decriminalization, you're going to see all kinds of situations where cops pull over drivers," said Mr. Reimer. "There is no way for the officer to gauge what level of THC, if any, is in the bloodstream of the driver." Mr. Reimer said the federal government has failed to deal with these issues, just as he thinks it has bungled the matter of medicinal marijuana. "They should have been thinking of this 20 years ago. Instead, they buried their heads in the sand and now they've been dragged kicking and screaming into it and they've been caught with their pants down." As a defence lawyer, Mr. Reimer defended dozens, if not hundreds, of impaired drivers. He is so well-known in the justice community in Renfrew County that an out-of-county Crown, Mac Lindsay of Ottawa, was brought in to prosecute. Mr. Lindsay declined to discuss the case in detail yesterday, except to say he would be calling the arresting officer and a toxicologist. Proving the effect of marijuana on a driver -- at least to a criminal court standard -- has been difficult. In Eastern Ontario during the last eight years, there have been two well-known failures, blamed on holes in the Criminal Code. Untitled Document Contents The DWI Detection Guide Explanations of the 24 driving cues Summary A description of post-stop cues thatare predictive of DWI Introduction More than a million people have died in traffic crashes in the UnitedStates since 1966, the year of the National Traffic and Motor Vehicle SafetyAct, which led to the creation of the National Highway Traffic Safety Administration,or NHTSA. During the late 1960s and early 1970s more than 50,000 people lost theirlives each year on our nation's streets, roads and highways. Traffic safetyhas improved considerably since that time: the annual death toll has declinedsubstantially, even though the numbers of drivers, vehicles, and miles drivenall have increased. When miles traveled are considered, the likelihood ofbeing killed in traffic during the 1960s was three to four times what itis today. The proportion of all crashes in which alcohol is involved also has declined.The declines in crash risk and the numbers of alcohol-involved crashes areattributable to several factors, including the effectiveness of public informationand education programs, traffic safety legislation, a general aging of thepopulation, and law enforcement effort. NHTSA research contributed to the improved condition, in part, by providingpatrol officers with useful and scientifically valid information concerningthe behaviors that are most predictive of impairment. Continued enforcementof DWI laws will be a key to saving lives in the future. For this reason,NHTSA sponsored research leading to the development of a new DWI detectionguide and training materials, including a new training video. Many thingshave changed since 1979, but like the original training materials, the newdetection guide describes a set of behaviors that can be used by officersto detect motorists who are likely to be driving while impaired. Building upon the previous NHTSA study, the researchers interviewed officersfrom across the United States and developed a list of more than 100 drivingcues that have been found to predict blood alcohol concentrations, or BACs,of 0.08 percent or greater. The list was reduced to 24 cues during threefield studies involving hundreds of officers and more than 12,000 enforcementstops. The driving behaviors identified by the officers are presented inthe following four categories: 1) Problems in maintaining proper lane position, 2 ) Speed and braking problems, 3) Vigilance problems, and 4) Judgment problems. The cues presented in these categories predict that a driver is DWI atleast 35 percent of the time. For example, if you observe a driver to beweaving or weaving across lane lines, the probability of DWI is more than.50, or 50 percent. However, if you observe either of the weaving cues andany other cue listed in this booklet, the probability of DWI jumps to atleast .65, or 65 percent. Observing any two cues other than weaving indicatesa probability of DWI of at least 50 percent, although some cues, such asswerving, accelerating for no reason, and driving on other than the designatedroadway, have single-cue probabilities greater than 70 percent. Generally,the probability of DWI increases substantially when a driver exhibits morethan one of the cues. The research suggests that these training materials will be helpful toofficers in: Detecting impaired motorists, Articulating observed behaviors on arrest reports, and Supporting officers' expert testimony. Crimes - OUIL - Third Offense - Constitutionality The statute establishing the felony of OUIL-third offense is constitutional. In this case, the defendant was charged with OUIL-third offense, but at the preliminary examination the district court dismissed the charge on the basis that the OUIL-third offense statute was unconstitutional. The circuit court properly reinstated the charge. MCL 257.625(6)(d) Crimes - OUIL - Third Offense - Elements - Prior Convictions Generally, a person convicted of operating a vehicle while under the influence of liquor is guilty of a misdemeanor, but if the violation occurred within ten years of two or more prior convictions, the person is guilty of a felony and must be sentenced to one to five years and a fine of $500 to $5,000. The offense of OUIL-third offense is a separate crime from OUIL. The prosecutor must establish each prior conviction beyond a reasonable doubt to prove OUIL-third offense. MCL 257.625(6)(d) Crimes - Enhancement - Elements - Prior Convictions When a statute establishes a separate crime rather than a procedure for sentence enhancement, the prosecutor must prove all elements of the offense, including the prior convictions. Statutes - Construction - Legislature - Knowledge of Existing Laws - Judicial Interpretation The Legislature is presumed to be aware of judicial interpretations of statutes, and the Legislature's silence on an issue construed suggests agreement with the judicial construction. Jurisdiction and Venue - Jurisdiction - Circuit Court - Misdemeanor/Felony Charge When a defendant is charged with both a felony and a misdemeanor, the circuit court has jurisdiction over the entire case. Preliminary Examination - Bindover - OUIL-Third - Elements - Prior Convictions - Out-of-State At a preliminary examination regarding a charge of OUIL-third offense, the prosecutor must comply with the rules of evidence and must prove the substantial correspondence between Michigan's drunk driving laws and any out-of-state prior convictions.
