Manilla, Esquire , PA DUI Law, DWI Laws A person shall not drive, operate or be in actual physical control of the movement of a vehicle in any of the following circumstances:(1) While under the influence of alcohol to a degree which renders the person incapable of safe driving; (2) While under the influence of any controlled substance, as defined in the act of April 14, 1972 (PL 233, No. 64) known as The Controlled Substance, Drug, Device and Cosmetic Act, to a degree which renders the person incapable of safe driving; (3) While under the combined influence of alcohol and any controlled substance to a degree which renders the person incapable of safe driving; (4) While the amount of alcohol by weight in the blood of: (i) an adult is 0.10% or greater; (ii) a minor is .02% (operation of a commercial vehicle is .04%) Margiotti & Mittman , PA DUI Law, DWI Laws 75 PA.C.S. 1553 (Occupational limited license). Subsection (b)(1) adds getting to treatment as one of the circumstances underwhich a driver may use an occupational limited license. The driver's petitionmust now identify not only the employer but also the educational institution ortreatment facility. Subsection (d)(6) specifies that anyone who has been adjudicated delinquent,granted a consent decree or granted ARD for DUI may not be issued anoccupational limited license unless the suspension or revocation for thatconviction has been fully served. This provision also allows occupational limited licenses for those whoselicenses have been suspended for a first violation of 18 PA.C.S. 6308. Subsection (d)(8) specifies that anyone convicted of DUI must serve the entiresuspension or revocation before being eligible for an occupational limitedlicense. However, a person convicted under 3802 who does not have a prioroffense as defined in 3806(a) shall be eligible for an occupational limitedlicense after serving 60 days of the suspension according to subsection (d.1). Aperson convicted under 1547(b)(1)(ii) or 3804(e)(2)(ii), relating to an18-month suspension for a first-degree misdemeanor, shall be eligible for anoccupational limited license if the individual 1) is otherwise eligible forrestoration; 2) has served 12 months of the suspension; 3) has no more than oneprior offense as defined in 3806(b); 4) only operates a vehicle with anignition interlock system and 5) has certified that each vehicle owned by orregistered to the person has been equipped with an ignition interlock system. Aperiod of ignition interlock accepted under subsection (d.2) shall not counttowards the one-year mandatory period of ignition interlock imposed under 3805. Subsection (f) specifies that an occupational limited license can only be usedbetween the driver's residence and place of employment or study or in the courseof employment or study where the operation of a vehicle is required. Theoccupational limited license can also be used to and from a scheduled oremergency medical examination or treatment, including treatment required underChapter 38. The operating privilege of a driver with an occupational limitedlicense remains under suspension or revocation except when the driver is withinthe conditions of the limited license. A driver must have a completedoccupational limited license affidavit at all times while operating a vehicle,except when operating a vehicle to a location for emergency medical treatment. Subsection (f)(2) specifies that a driver with an occupational limited licensemay not operate a school bus. Subsection (c) raises the fee for applying for an occupational limited licensefrom $25 to $50. Subsection (f)(3) establishes a summary offense and a $200 finefor violating the conditions of the occupational limited license. The Smoking Gun: Archive Turns out another "Big Brother 3" contestant knows what it's like to get nailed for drunk driving and other crimes, The Smoking Gun has learned. Amy Crews, 24, was arrested in February 1999 and charged with driving while intoxicated after crashing her Toyota in a one-car accident near her Arkansas home. According to this West Memphis Police Department report , Crews's car struck a concrete mailbox, rolled onto its roof, and slid for 25 yards before stopping. When cops arrived at 3:30 AM, Crews not only failed a field sobriety test, but registered a .14 on a breathalyzer machine (in 1999, the Arkansas legal limit was a blood alcohol content of .10). At the time of her DWI arrest, Crews was 20. Since 1935, the legal drinking age in Arkansas has been 21. In March 1999, Crews pleaded no contest in Crittenden County District Court to the misdemeanor DWI charge. She was hit with a one-year suspended jail term, fined $1000, directed to pay court costs of $300, and ordered to attend alcohol safety school and an alcohol education class. But it's unclear what Crews might have learned during those courses, since she is often seen guzzling the wine and beer of other Big Brother houseguests, some of whom have talked openly about her prodigious alcohol consumption. In fact, contestant Tonya Paoni--who was just voted off the show--confronted Crews last week and told her she should enter Alcoholics Anonymous upon leaving the Big Brother compound. Crews appears to relish her role as the show's tipsy, boyfriend-stealing Southern belle, a young woman who does not hesitate to denigrate fellow contestants she deems beneath her. Allison Grodner, the reality TV show's executive producer, has said that "Big Brother 3" staffers "fell in love with Amy" during auditions. "She's a very classy person, opinionated and judgmental in her way, and we like that," said Grodner. "She's not afraid to say what she feels, so we've really enjoyed her." The 1999 DWI arrest is not the only entry on Crews's rap sheet: * While a student (briefly) at the University of Mississippi, Crews got nailed in April 1997 for possession of beer by a minor , a misdemeanor. She was fined $172 in Oxford Municipal Court. * In December 1998, Crews was arrested for reckless driving and driving with a revoked or suspended license after leading an Arkansas state trooper on a high-speed chase. In fact, Crews was going so fast on Interstate 40--92 mph in a 65mph zone--that the arresting officer noted in his report that he "attempted to catch up with the speeding vehicle but found it to be very difficult." In early-1999, Crews was convicted of misdemeanor reckless driving after a Crittenden County District Court trial (she had previously paid a $75 fine to settle the driving with a suspended or revoked license charge). * In February 1999, a West Memphis Municipal Court judge issued a warrant for Crews's arrest after she bounced a check --for a whopping $6.77--at the Flash Market gas station. * That warrant remained outstanding until Crews had another run-in with cops, this time in May 1999. She was arrested after a bizarre fender-bender at a bank drive-thru window. When cops responded to the accident scene they discovered Crews was driving though her license had been suspended as a result of the March 1999 DWI conviction. And a warrant search also turned up the bum check--a violation of the Arkansas "Hot Check Law." The check charge was eventually dropped when Crews made restitution to the gas station. And after pleading no contest in Crittenden County District Court, Crews paid a $95 fine to settle the other misdemeanor charges. On July 22, TSG reported that Chiara Berti, another "Big Brother 3" contestant, was arrested in late-May on drunk driving charges , which are pending in Los Angeles Superior Court. Asked about the 25-year-old's arrest, which came during the final stage of "Big Brother 3" auditions, CBS spokesperson Chris Ender gave reporters a flippant comment about the DUI charge: "On the brighter side, she won't be doing any driving in the house." Incredibly, Ender repeated the same comment when TSG spoke to him today (7/29) about Crews's alcohol problem. Shambo, 31, of Lee Road, Mexico , was arrested officers with the Oswego County Sheriff's Department and charged with driving while intoxicated, driving with a blood-alcohol content greater than 0.08 percent of alcohol or more and speeding after officers stopped him on state Route 104 in Mexico at 12:16 a.m. Shambo was issued tickets returnable to Mexico Town Court Nov. 18. On Nov. 5, officers with the Oswego County Sheriff's Department arrested Jeremy D. Raponi, 24, of 103 So. Sixth St., Fulton , and charged him with driving while intoxicated, driving with a blood-alcohol content greater than 0.08 percent of alcohol or more, second-degree aggravated unlicensed operation, no inspection certificate, operating a vehicle with a suspended registration and driving on the shoulder of the road after a one-vehicle accident that occurred on Honey Hill Road in Granby Oct. 27. Police said Raponi is scheduled to answer the charges in Granby Town Court Dec. 6. On Nov. 5, Paul L. Cote 2nd, 26, of 7 Oneida St., Cleveland , was operating a 2004 Dodge pickup truck eastbound on state Route 49 in West Monroe at 8:05 a.m. when he reportedly failed to stop at the red light at the intersection of the Interstate-81 northbound off-ramp and collided with a northbound 2000 Honda driven by Jennifer L. Laquidari, 24, of 103 Breman Ave., Mattydale. According to officers with the Oswego County Sheriff's Department, Laquidari was transported by ambulance to St. Josephs Hospital in Syracuse. Driver distraction appears to have been a contributing factor in the incident as an item was reportedly rolling under Cotes foot at the time of the incident, according to reports. Cote was ticketed for failure to yield the right of way at a green light. On Nov. 5, Albert L. Taylor, 55, of 129 Chester St., Syracuse , was traveling south on county Route 14 in Granby when he reportedly lost control of his 1993 Chevrolet, causing it to drive off the roadway and hit an earth embankment before overturning into a ditch, according to officers with the Oswego County Sheriff's Department. Police said the incident took place 1/8 of a mile north of King Road. Taylor, the sole occupant, was transported by ambulance to St. Josephs Hospital in Syracuse. Slippery pavement appears to have been a contributing factor with road conditions reportedly wet from rain, police reports said. On Nov. 5 at 11:30 p.m., Christopher J. Miller, 21, of 22 Pulaski St., Altmar , was arrested by officers with the Oswego County Sheriff's Department and charged with numerous traffic violations following a traffic stop that was initiated by officers in the town of Mexico. Miller was charged with unlawful possession of marijuana, third-degree aggravated unlicensed operation of a motor vehicle, unauthorized removal of a sticker, driving an unregistered motor vehicle, operating a vehicle without insurance and improper plates. He was arraigned before the Hon. James Gracey, Mexico Town Court, and remanded to the Oswego County Correctional Facility in lieu of $500 cash bail or $1,000 bond. He is scheduled to return to court Nov. 23. On Nov. 6 at 6:40 p.m., George E. Sheldon, 22, of 1085 state Route 176, Fulton , was arrested by officers with the Oswego County Sheriff's Department following a domestic incident that took place at a Granby residence. Police charged Sheldon with second-degree menacing, fourth-degree criminal mischief and endangering the welfare of a child, all class-A misdemeanors, after he allegedly threatened the resident with a knife while in the presence of a minor and then broke a window of the victims vehicle by throwing a car jack through the window. Sheldon was arraigned before the Hon. Luther Dennison, Hannibal Town Court, and remanded to the Oswego County Correctional Facility in lieu of $1,000 cash bail or $2,000 bond. He was scheduled to appear in Granby Town Court Nov. 8. On Nov. 6 at 11:20 p.m., while on routine patrol, officers with the Oswego County Sheriff's Department initiated a traffic stop on state Route 3 near Atkinson Road in Richland after reportedly observing a vehicle cross the fog line several times. The driver, Marshall L. Blodgett, 23, of 2285 county Route 22, Richland , was subsequently arrested and charged with third-degree aggravated unlicensed operation of a motor vehicle, failure to keep right and operating a vehicle with suspended plates, police said. Blodgett was released on appearance tickets returnable to Richland Town Court Nov. 22. While traveling southbound on county Route 17 in Amboy Nov. 7 at 1:47 p.m., officers with the Oswego County Sheriff's Department observed a vehicle pulled over on the east shoulder of the road and reportedly saw a spilled can of beer on the ground near the drivers door. Further investigation found the driver, Ralph J. Gardner, 24, of 506 Cable Road, Williamstown , to be under the influence of alcohol, which was later confirmed. He was subsequently arrested and charged with driving while intoxicated, driving with a blood-alcohol content greater than 0.08 percent of alcohol or more and consumption of alcoholic beverages in certain vehicles, police said. Gardner was released to a third party and is scheduled to answer the charges in Amboy Town Court Nov. 16. On Nov. 7 at 5:30 a.m., Oswego County Sheriffs officers investigated a stabbing that took place at a residence in West Monroe. Police said the investigation led to the arrest of Shane T. Andrews, 24, of 604 Montrose Avenue, Syracuse , who was charged with two counts of second-degree assault, a class-D felony, and fourth-degree criminal possession of a weapon, a class-A misdemeanor, after he was accused of stabbing a male victim in the chest with a knife and causing a two inch gash on the victims left bicep following a fight that took place outside the residence. The victim was transported by ambulance to State University Hospital in Syracuse for treatment. A second male, who tried to break up the fight, also received a wound from the knife on his hand, police said. Members of the New York State Police assisted when they stopped the vehicle Andrews had left the scene in, approximately two miles from the incident. Andrews was arraigned before the Hon. John Demong, West Monroe Town Court, and remanded to the Oswego County Correctional Facility in lieu of $2,000 cash bail or $3,000 secured bond. He was scheduled to return to court Nov. 8.
