The first is the DWI case in criminal court ; the second is the DMV case, where the New York DMV is empowered to suspend the driving privileges of those accused of DWI or DWAI (driving while abilities are impaired by alcohol) . New York DWI cases (also known as DUI – Driving Under the Influence) can be brought under one of two theories: either violation of the DWI "per se" law (which is based only on alcohol level, not driving impairment) , or under a traditional "common law" theory (where the prosecution must prove that the driver is intoxicated) . Intoxication, for the purpose of Vehicle and Traffic Laws, is a condition where the motorist lacks the necessary physical and mental skills to operate a motor vehicle as a reasonable and prudent driver. New York DWI arrests based on the common law theory do not require any measurement of BAC ; they may be based entirely on the opinion of the arresting officer. DWI cases can be "aggravated" (with harsher punishment and penalties) where the BAC is .15 or more , where there is a traffic accident, refusal to take the chemical test , or any other attempt to evade police or flee the scene of a DWI accident. New York DWI law is unique, in that it gives all motorists a qualified right to consult with a DWI lawyer before deciding whether to take or refuse the chemical test. (It is "qualified" because those arrested have a right to call and obtain advice from a DWI lawyer, but the police do not have to wait for that lawyer to show up.) New York DWI lawyers know that taking late-night calls is simply part of the job description. It is critical to consult with a qualified New York DWI attorney before deciding this issue, since taking or refusing the test is an important and complicated decision following a drunk driving arrest. top DWI punishment in New York will depend upon whether the drunk driving arrest is for a misdemeanor or a felony . (A misdemeanor DWI / DUI case is one than can be punished by up to one year in jail; a felony drunk driving arrest may be punished for more than a year in state prison.) A first-offense Driving While Intoxicated (DWI) case is a misdemeanor . However, if there has been a prior DWI or drunk driving conviction within 10 years of the arrest, the new charge is a felony. The 10-year period is calculated from the date of conviction of the prior DWI case, through the date of arrest for the new DWI case. DWI arrests can result in a variety of punishments; the sentence given for a drunk driving conviction will depend upon the particular DWI charge, and whether there are aggravating or mitigating factors. New York DWI Penalties in criminal court are as follows: Driving While Impaired by Alcohol, VTL Section 1192.1 : Considered a non-criminal "traffic infraction" which does not leave the driver with a criminal record, this is the least serious DWI / DUI offence. The penalties can range from a minimum fine of $300.00 and a maximum fine of $500.00 to up to 15 days in jail or both. However, if the driver has already been convicted of one prior DWI / DUI offense in New York, the penalty is increased to a minimum fine of $500.00 and a maximum fine of $750.00 or 30 days in jail or both. If the driver has been convicted of two or more DWI offenses in New York, then the classification of this DWI offense is changed to a misdemeanor (which does give the driver a criminal record) with a minimum fine of $750.00 and maximum of $1,500.00, plus up to 180 days in jail or both. A mandatory 90-day suspension of the driver's license to operate a vehicle will be imposed if the motorist has no prior DWI convictions. The suspension is for 6 months where the motorist does have a prior DWI conviction. However, NY courts are often willing to postpone that suspension for 20 days in order for the motorist to petition the Department of Motor Vehicles for a restricted license that will permit them to drive to and from work only. Driving While Intoxicated, VTL Section 1192.2: This is the standard, garden-variety drunk driving offence that is typically charged when a motorist is arrested for DWI. It is considered a misdemeanor and does constitute a crime, giving the driver a criminal record. The minimum penalty, assuming no prior convictions for DWI as a misdemeanor, is a minimum fine of $500.00 and a maximum fine of $1,000.00 or both. A term of no more than one year in a NY prison is authorized. The mandatory license revocation is for 6 months, with the same provision for a restricted license through DMV as outlined above. DWI as a felony offense: When a person has already been convicted of DWI as a misdemeanor (as opposed to Driving While Impaired, a "traffic infraction") the next DWI is much more serious. If the second DWI case is for Driving While Intoxicated, most commonly brought under VTL Section 1192.2, the new charges are raised to the level of a class "E" felony. The penalties increase as well. The minimum fine is $1,000.00 with a maximum fine of $5,000.00 possible. The motorist is also more likely subject to a period of probation for 5 years or may even be incarcerated for a period of up to one and one-third to four years. In such cases, NY courts can combine the penalties imposed, depending on the circumstances. A term of 6 months incarceration with the balance of 5 years spent on probation along with the fine , license revocation and drinker/driver program is possible. Laws: driving under the influence laws The words dui laws, DUI law, D.U.I, and "driving under the influence", are usedby DUI lawyers and DUI attorneys in United States DUI Law . The expression "DUI laws" is not found in the CriminalCode of Canada. Canadians use terminology other than DUI laws or "driving underthe influence laws". We use the words "impaired driving laws" or"impaired operation laws", or "impaired care or control laws" but not "driving under the influencelaws"or "driving under impairment laws". In Canadian laws it is any impairment byalcohol or a drug of one's ability to operate a motor vehicle combined withoperation that is forbidden, not "driving under impairment" or"driving under the influence" (DUI). It is also a "DUI laws"criminal offence in Canada to drive having more than 80 milligrams of alcoholper 100 mls of blood whether one's ability to drive is"influenced" (DUI) or not . Canada has two main substantive DUI law criminal offences: impaired operation or careor control , over 80 operation or careor control Section 253. Every one commits an offence who operates a motorvehicle or vessel or operates or assists in the operation of an aircraft orof railway equipment or has the careor control of a motor vehicle, vessel, aircraft or railway equipment,whether it is in motion or not, (a) while the person's ability to operate the vehicle, vessel, aircraft or railway equipment is impaired by alcohol or a drug; or (b) having consumed alcohol in such a quantity that the concentration in theperson's blood exceeds eighty milligrams of alcohol in one hundred millilitresof blood. Impaired operation or care or control in Canada includes operation or care orcontrol of a motor vehicle, vessel, or aircraft while one's ability to operateis impaired by alcohol or a drug to any degree of impairment. This DUI offence isproven by evidence of bad driving and various indicia of impairment observedsuch as slurred speech, difficulty with standing walking turning, red glassyglossy bloodshot eyes, dilated pupils, odor odour of an alcoholic beverage,complexion flushed face, and performance on physical tests. The DUI offence of excess blood alcohol or over 80 is usually proven by breathtests that determine blood alcohol concentration using and approved instrumentsuch as a Breathalyzer 900 900A or Intoxilyzer 5000C. Blood tests are used inDUI cases where breath testsare not practical to provide evidence of blood alcohol concentration. Both Canadian DUI laws are federal criminal law offences. The Crown inCanada can prosecute a DUI in either of two ways. DUI offences are hybridoffences in Canada. The Crown may prosecute a DUI offence by indictment (roughlysimilar to a US felony DUI) or they may prosecute a DUI offence by summaryconviction (roughly similar to a US misdemeanor). The local Crown Attorney mustelect whether to proceed with the D.U.I. by indictment or by summary conviction.Until he or she elects, the DUI offence is deemed to be prosecuted byindictment. Most Canadian DUI offences are prosecuted by summary conviction. The usual penalty for a first DUI offence in Canada is a fine. The minimumsecond DUI offence penalty is 14 days in jail. The minimum penalty for a thirdDUI is 90 days in jail. There is always a DUI driving prohibition and the local province will suspend a DUI offender's driver's licence . If a US citizen or other non-Canadian citizen is convicted of a DUI offencein the USA or a dui offence in any country other than Canada, the DUI offenderwill be inadmissibleto Canada on grounds of criminality, unless rehabilitated , because the DUIoffence is deemed to be a Canadian DUI offence and all Canadian DUI offences aredeemed indictable (similar to a US felony - see above) unless the Crown haselected to proceed with the DUI offence by summary conviction (which will neverhave happened because the DUI offense occurred outside Canada. The situationwill be different if the DUI offence occurs in Canada and the Crown elects toproceed by summary conviction which they normally do. This represents 40% of all people killed in traffic accidents that year. (See the US map of all deaths related to intoxication .) FACT: At present, there are 17 states with laws making it illegal to drive at a blood alcohol concentration (BAC) over 100 mg/dL (0.1%); 32 states, the District of Columbia, and Puerto Rico have a lower cutoff point, which is 80 mg/dL. In October 2000, the federal government passed a law mandating that all states enact laws lowering the legal driving BAC to 80 mg/dL by October 2003 or face the penalty of withholding 2% of their federal highway construction funds. These cutoff points establish the level below which driving is per se illegal in and of itself. Per se means that the only factor considered is the BAC. Whether the person actually is intoxicated, behaves as if he or she is intoxicated, or appears to be intoxicated does not count. Numerous studies demonstrate that almost all drivers are impaired at a level of 80 mg/dL with respect to critical driving skills such as braking, steering, and changing lanes. Impairment begins as low as 20 mg/dL and is common at 50 mg/dL. Most significant is that impairment of skills begins at a much lower level than required to exhibit obvious signs of being drunk. The per se level mandated by the federal government for drivers of commercial vehicles is a mere 40 mg/dL (0.04%). This applies to all 50 states. In 1992, the National Highway Transportation and Safety Administration recommended that all states lower their illegal per se levels to 80 mg/dL (0.08%). Only 19 states have done so. A strong lobby representing sellers of alcoholic beverages has been instrumental in preventing adoption of the recommended levels by all states. Also, the expense of enforcing the lower limits is a significant issue. All countries in Europe are below the 100 mg/dL cutoff common in the US. Countries with a cutoff of 80 mg/dL include Austria, Britain, Denmark, Germany, Italy, Ireland, Luxembourg, Spain, Switzerland, and Canada. Countries with a cutoff of 50 mg/dL include Belgium, Finland, France, Greece, Netherlands, and Portugal. Sweden and Norway have a 20 mg/dL cutoff. American society continues to be complacent about drunk drivers. Even when a person who is drunk kills someone in a motor vehicle accident, the sentence tends to be extremely light, if imposed at all. Defending drunk drivers is a huge legal business. Over the years, numerous creative defenses have been successfully employed. Some of the popular ones include these: Driver claims to have consumed the alcohol after the accident to calm nerves. Driver claims that he or she only had a soft drink at the party, but someone else laced it with alcohol. Driver claims to have medical conditions that impede the normal metabolism of alcohol. Driver says the alcohol swab used to clean the skin before the blood sample was drawn contaminated the skin. (Such swabs contain isopropyl alcohol, not ethanol, and do not register on the ethanol test.) Specimen was mixed with another in the lab.
