The Smoking Gun: Dick Cheney's Youthful Indiscretions OCTOBER 28--Vice President Dick Cheney's closest aide, I. Lewis "Scooter" Libby , was fingered today in the "Plamegate" leak investigation. While Special Counsel Patrick Fitzgerald has said that his probe might not be complete, TSG has no idea if Cheney himself ran afoul of the law in connection with the disclosure of a CIA officer's identity. But we do know that the veep has previously been busted. Twice. Back when he had hair and liked to get loaded and drive. Here's a reprise of a story chronicling Cheney's DWI history. When news of George W. Bush's drunken driving arrestsurfaced during the final week of the 2000presidential campaign, Republicans tried to dismiss itas one of those "youthful indiscretions" Bush hadsteadfastly refused to discuss. Of course, when he gotpopped in Kennebunkport in 1976, Bush was 30 yearsold, hardly a kid. Vice President Dick Cheney, on the other hand, couldactually argue that his two DWIs came when he wasyoung and reckless. Court and police records obtained by The Smoking Gunshow that Cheney was convicted of drunk driving twiceduring an eight-month period in the early 1960s in hishome state of Wyoming. The two convictions came whenCheney was 21 and 22 and resulted in fines and a briefsuspension of his driver's license. On November 2, in the wake of the Bush DWI discovery,a Cheney spokesperson told reporters that the vicepresidential candidate also had a rap sheet. But theBush-Cheney campaign refused to provide any furtherdetails about the DWI busts. So TSG will now handlethat chore. Cheney first privately disclosed the arrests in 1989,after he had been nominated for Secretary of Defense.According to an account in Bob Woodward's "TheCommanders," Cheney told members of the Senate ArmedServices committee about the DWI arrests during aclosed confirmation hearing. Cheney told the senatorsthat he believed it would be best to publicly disclosethe busts. But Armed Services committee members saidthere was no need for the disclosure and subsequentlyconfirmed Cheney in a 20-0 vote. Following the May 1991 publication of Woodward's book,there was no mention of Cheney's arrests until thebrief confirmation offered by the candidate'sspokesperson last November. But the vice presidenthimself mentioned his rap sheet in an interview in thecurrent issue (dated May 7) of The New Yorker. Cheneynoted that after dropping out of Yale in early 1961,he found himself "working, building power lines,having been in a couple of scrapes with the law." Thebusts, he said, made him "think about where I was andwhere I was headed. I was headed downa bad road, if I continued on that course." Cheney's first DWI conviction came in November 1962when he was 21. According to this docket fromCheyenne's Municipal Court , Cheney was nailed fordrunkenness and "operating motor vehicle whileintoxicated." A Cheyenne Police Judge found Cheneyguilty of the two charges and hit him with a 30-daysuspension of his driver's license. Cheney also had toforfeit a $150 bond posted at the time of his arrest.Further information about the case--such as thedefendant's blood alcohol content or whether Cheneywas jailed following the bust--is unavailable sinceother court records from that period have beendestroyed, according to Wyoming officials. Details of Cheney's second Wyoming arrest, in July1963, have also fallen victim to time and recordsdestruction practices at the local Municipal Court.But a police arrest card (similar to the one thathaunted Dubya) maintained by the Rock Springs PoliceDepartment shows that Cheney was fined $100 for hissecond DWI conviction. The card lists the chargeagainst Cheney, who was then working as a groundmanlaying power lines, as "11-44," the criminal codeclassification for drunken driving, according toPolice Chief Neil Kourbelas. At the time of the RockSprings arrest, Kourbelas said that local cops andjudges would not have known that young Cheney was aboozing 'n driving recidivist. The police department,Kourbelas said, "wouldn't have had the ability toautomatically check with other jurisdictions to findout if anyone had had prior arrests or convictions. The rest of the device varies with the type. Breathalyzer The Breathalyzer device contains: A system to sample the breath of the suspect Two glass vials containing the chemical reaction mixture A system of photocells connected to a meter to measure the color change associated with the chemical reaction To measure alcohol, a suspect breathes into the device. The breath sample is bubbled in one vial through a mixture of sulfuric acid, potassium dichromate, silver nitrate and water. The principle of the measurement is based on the following chemical reaction: In this reaction: The sulfuric acid removes the alcohol from the air into a liquid solution. The alcohol reacts with potassium dichromate to produce: chromium sulfate potassium sulfate acetic acid water The silver nitrate is a catalyst , a substance that makes a reaction go faster without participating in it. The sulfuric acid, in addition to removing the alcohol from the air, also might provide the acidic condition needed for this reaction. During this reaction, the reddish-orange dichromate ion changes color to the green chromium ion when it reacts with the alcohol; the degree of the color change is directly related to the level of alcohol in the expelled air. To determine the amount of alcohol in that air, the reacted mixture is compared to a vial of unreacted mixture in the photocell system , which produces an electric current that causes the needle in the meter to move from its resting place. The operator then rotates a knob to bring the needle back to the resting place and reads the level of alcohol from the knob -- the more the operator must turn the knob to return it to rest, the greater the level of alcohol. The Chemistry of Alcohol The alcohol found in alcoholic beverages is ethyl alcohol (ethanol). The molecular structure of ethanol looks like this: H H 3 C - C - O - H H where C is carbon, H is hydrogen, O is oxygen and each hyphen is a chemical bond between the atoms . For clarity, the bonds of the three hydrogen atoms to the left carbon atom are not shown. The OH (O - H) group on the molecule is what makes it an alcohol. There are four types of bonds in this molecule: carbon-carbon (C - C) carbon-hydrogen (C - H) carbon-oxygen (C - O) oxygen-hydrogen (O - H) The chemical bonds between the atoms are shared pairs of electrons. Chemical bonds are much like springs: They can bend and stretch. These properties are important in detecting ethanol in a sample by infrared (IR) spectroscopy . Independent - November 22, 2005: Navajo Nation records 8,100 DWI arrests; First lady Vikki Shirley urging area motorists to 'Tie One on for Safety' Navajo Nation records 8,100 DWI arrests First lady Vikki Shirley urging area motorists to 'Tie One on for Safety' By John Christian Hopkins Diné Bureau WINDOW ROCK — Navajo Nation First Lady Vickie Shirley is MADD as heck, and she's doing something about it. On Monday, she launched the annual "Tie One on for Safety" ribbon campaign, sponsored by Mothers Against Drunk Driving and Taketa, the nation's largest manufacturer of seatbelts. Annually, 17,000 people die in alcohol-related traffic deaths across the country. Drunken driving is a concern on the reservation, with 8,100 DUI arrests between Oct. 1, 2004 and Sept. 30, 2005. The communities with the highest number of drunken driving arrests are Shiprock (1,945), Chinle (1,660) and Window Rock (1,426). In the five-year period between 1998 and 2003 there were 44,628 drunken driving arrests on the reservation. The first lady and her husband, President Joe Shirley, started up the Window Rock chapter of MADD in 2003 after their daughter was killed in a drunken driving accident. This Thanksgiving Day will mark the fourth anniversary of their loss. "Because of what happened to us, we're taking our message out to drive safely and wear a seatbelt," Shirley said. In addition to the ribbons which will be silver this year in honor of MADD's 25th anniversary Shirley's group will be handing out information on seatbelt usage and the proper use of child seats. A National Highway Traffic Safety Administration study found that between 1975 and 2004 an estimated 195,382 lives were saved because of using a seatbelt. Ninety percent of traffic fatalities are caused by drunken drivers or a failure to use a seatbelt, said Bob Kittle, vice president of sales and marketing for Takata. A buckled seatbelt is the best defense against a drunken driver, Kittle said. "Drunk driving crashes are the most frequently committed violent crime in America," said Glynn Birch, national president of MADD. Sadly, the crime is "100 percent preventable," she added. One of her priorities as first lady is to "advocate for victims of drunken driving," Shirley said. "We need to be mindful of what we're doing," Shirley said. "We need to be responsible for what we do." Shirley is looking for support from neighboring communities, too. "We're absolutely going to have a zero tolerance policy," said Sgt. Dave Nelson of the Arizona Highway Patrol. "If you drink and you drive, you are going to jail." Deputy Mike Camarillo of the Apache County Sheriff's Office echoed Nelson's words and pledged continue cooperation with Navajo law enforcement officials to curb drunken driving. "During this time of year a lot of our people go crazy with their driving," said Lawrence Garnanez of the Navajo Nation highway safety department. He urged people to drive defensively because "there's no room for error." There are 2,332 paved roads on the Navajo reservation, 124 gravel roads and 5,604 unimproved roads, Garnanez said. "We cannot afford to mix alcohol and driving," he added. Untitled Document Contents The DWI Detection Guide Explanations of the 24 driving cues Summary A description of post-stop cues thatare predictive of DWI Introduction More than a million people have died in traffic crashes in the UnitedStates since 1966, the year of the National Traffic and Motor Vehicle SafetyAct, which led to the creation of the National Highway Traffic Safety Administration,or NHTSA. During the late 1960s and early 1970s more than 50,000 people lost theirlives each year on our nation's streets, roads and highways. Traffic safetyhas improved considerably since that time: the annual death toll has declinedsubstantially, even though the numbers of drivers, vehicles, and miles drivenall have increased. When miles traveled are considered, the likelihood ofbeing killed in traffic during the 1960s was three to four times what itis today. The proportion of all crashes in which alcohol is involved also has declined.The declines in crash risk and the numbers of alcohol-involved crashes areattributable to several factors, including the effectiveness of public informationand education programs, traffic safety legislation, a general aging of thepopulation, and law enforcement effort. NHTSA research contributed to the improved condition, in part, by providingpatrol officers with useful and scientifically valid information concerningthe behaviors that are most predictive of impairment. Continued enforcementof DWI laws will be a key to saving lives in the future. For this reason,NHTSA sponsored research leading to the development of a new DWI detectionguide and training materials, including a new training video. Many thingshave changed since 1979, but like the original training materials, the newdetection guide describes a set of behaviors that can be used by officersto detect motorists who are likely to be driving while impaired. Building upon the previous NHTSA study, the researchers interviewed officersfrom across the United States and developed a list of more than 100 drivingcues that have been found to predict blood alcohol concentrations, or BACs,of 0.08 percent or greater. The list was reduced to 24 cues during threefield studies involving hundreds of officers and more than 12,000 enforcementstops. The driving behaviors identified by the officers are presented inthe following four categories: 1) Problems in maintaining proper lane position, 2 ) Speed and braking problems, 3) Vigilance problems, and 4) Judgment problems. The cues presented in these categories predict that a driver is DWI atleast 35 percent of the time. For example, if you observe a driver to beweaving or weaving across lane lines, the probability of DWI is more than.50, or 50 percent. However, if you observe either of the weaving cues andany other cue listed in this booklet, the probability of DWI jumps to atleast .65, or 65 percent. Observing any two cues other than weaving indicatesa probability of DWI of at least 50 percent, although some cues, such asswerving, accelerating for no reason, and driving on other than the designatedroadway, have single-cue probabilities greater than 70 percent. Generally,the probability of DWI increases substantially when a driver exhibits morethan one of the cues. The research suggests that these training materials will be helpful toofficers in: Detecting impaired motorists, Articulating observed behaviors on arrest reports, and Supporting officers' expert testimony.
