In addition, to qualify for the DUII Diversion Program, this arrest could not have involved an accident in which another person was injured. DIVERSION MUST BE FILED WITHIN 30 DAYS FROM ARRAIGNMENT The DUII Diversion Program requires a one (1) year commitment. The petition for the DUII Diversion Agreement must be filed with the Court within 30 days of the appearance date given by the officer on the bottom of the citation unless the Court allows a later filing date for good cause. A person charged with DUII must plead guilty or no contest to participate in the DUII Diversion Program. The person charged with DUII must appear in court on the date cited on the citation, unless otherwise notified by court or counsel. General Information DUI Diversion Program In summary, the DUII Diversion Program affords eligible persons the opportunity to participate in an alcohol/drug evaluation and education/rehabilitation program in lieu of being convicted of DUII. The DUII will be on your driving record as a diversion, not a conviction. If you have not been convicted of a DUII or have not participated in a DUII Diversion Program in the past 10 years prior to the current DUII arrest or in any similar drug or alcohol rehabilitation program in any state within the 10 years prior to this arrest, and if you have no other charge of murder, manslaughter, criminally negligent homicide, or assault resulting from the operation of a motor vehicle pending in any state on the date you file for diversion, and if this arrest did not involve an accident in which another person was injured, you may be eligible for the DUII Diversion Program. At the time of the alleged offense, you did not have a commercial driver license and were not operating a commercial motor vehicle. The DUII Diversion Program is a legal agreement with the Court that sets aside the DUII charge and enables the case to be dismissed in one year if all the terms of the Diversion Agreement are satisfied. The Diversion Program lasts one year or until all conditions have been satisfied. Upon completion of the Diversion Program, there is no DUII conviction entered on your driving record. Court costs are considerably lower. You must enter a “guilty” plea prior to entering the Diversion program. If you have successfully completed the alcohol treatment program, paid all of the required fees and complete all other requirements of the Diversion Program, the DUII charge will be dismissed by the Court. If you do not complete all the requirements of the Diversion Program, your diversion agreement may be terminated or revoked and set for sentencing. If you fail to appear in court when scheduled, a warrant will be issued for your arrest. Costs involved in the DUII Diversion Program If you decide to participate, you must pay a filing fee of $405.00 to the Court and a $150.00 screening interview fee to an Alcohol and Drug Evaluation Specialist. These costs are required by statute. In addition to the above fees, you must pay the costs of treatment and $20 processing fee to Jackson County Community Justice. The filing fee is due at the time you file a petition for entry into the DUII Diversion Program. You may set up a payment plan with the Court if you are unable to pay in full at the beginning of the program. The $150.00 evaluation fee must be paid prior to the screening interview unless you make other arrangements with the evaluator. Failure to pay the filing fee in full or when payments are due will result in the termination of your diversion agreement. Failure to pay for the evaluation and/or treatment may result in the termination of your diversion agreement. Driver’s License Thirty days after your arrest or citation, the Department of Motor Vehicles (DMV) will suspend your license if you failed or refused the breath test. You must contact DMV regarding this suspension and any application for a hardship permit. If you are convicted of DUII, your driving privileges will be suspended from one or three years or for your lifetime, depending on your driving record. The program begins promptly at 7:00 p.m. No one is admitted after 7:00 p.m. Fees - $25.00 Cash No admittance or credit for attendance without payment of $25.00 cash fee. There is no cost for friends or family members. Children under 10 years of age should not be brought as a guest. Do not consume controlled substances or alcohol within 8 hours prior to attending the Victim Impact Class. Please be aware there may be random alcohol testing upon entrance to the class. Violation of this rule will result in your exclusion from the panel. You may also be denied admission to any subsequent VIP panels which may affect completion of your diversion or probation conditions. However, the officer who stopped your car won't tell you this and will use the results of the tests to justify your arrest and to accumulate evidence to be used against you in court or at the Department of Motor Vehicles. Although the tests are supposed to test your ability to perform divided attention tasks (the theory being that driving is one of the ultimate divided attention tasks in that while driving you are actually performing many individual tasks at the same time-as an example pushing on the accelerator or brake while checking the mirror), they are actually designed for failure. Remember, it is your right to politely refuse to accept the officer's invitation to submit to any FSTs, either on the street or at the station. Do not confuse the FSTs with your obligation under the implied consent law to submit to a breath or blood test. A refusal to perform the FSTs cannot result in a penalty to you. Standardized (meaning accepted in the scientific community) FSTs Include: Nystagmus (Horizontal and Vertical Gaze): The officer should position an object (i.e., finger, pen, etc.) approximately one foot from the driver's face, and move the object from side to side while watching the subject's eyes. The officer watches the eyes for the ability to track the involuntary jerking or bouncing of the eyeball. This jerking or trembling is supposed to indicate someone has consumed and is being affected by alcohol. (However, nystagmus is naturally found in a percentage of the population and can be indicative of many medical and physiological disorders including an accident or recent head injury.) Walk and Turn: The subject takes nine to twelve heel-to-toe steps along a line, turns, and takes nine to twelve heel-to-toe steps back. The officer is looking to see if you can follow instructions, balance, stop during the test, not touch heel-to-toe, not step off the line, or lose balance while turning. One Leg Stand: The subject is instructed to stand with their heels together, arms at their side, and then told to raise one leg (your choice) six inches off the ground while counting out loud until the officer tells you to stop. Here, the officer is looking to see if you raise your foot the proper distance from the ground, look straight ahead, use your arms for balance, sway, hop, or put your foot down. Other Non Standardized FSTs Include: Rhomberg Balance Test (also known as the Modified Position of Attention): The subject stands still with their hands at your side, feet together and then is instructed to close his or her eyes, tilts the head back, and estimates 30 seconds. The officer is looking for signs your internal clock is off, problems with balance, body or eyelid tremors. If you open your eyes, sway, or tense your muscles, these "clues" could support the officer's subjective belief you are impaired. Finger to Nose: The subject stands with their feet together and eyes closed, and then is instructed to hold his or her arms to the side and alternate bringing the index finger to the nose. Here, the officer is looking to see how close to the tip of your nose you get on each try, if you touch the tip of your finger as instructed or the pad of the finger, if you sway, have body or eyelid tremors, muscle tension, or any other "clues" to support a finding of impairment. Other Non-Standardized Field Sobriety Tests include: Finger Count (counting 1 through 5 on the tips before reversing) Hand Pat (counting one and two while clapping and reversing) Alphabet Test (you are told not to sing) Counting Test (and reverse counting test) Preliminary alcohol screening device (PAS) Test: This is a portable breath test which is supposed to be used as a field sobriety test (usually the last) to determine the presence of alcohol. However, on the road and in a courtroom, this device is regularly used to show the content of your breath alcohol and as evidence of your guilt at hearing and in trial. It is important to understand, and the officer is supposed to advise you that this test is voluntary and not the one required by the Implied Consent Law. However, most of the time this is forgotten or ignored, in order to secure more evidence of your impairment and/or breath alcohol level. THE MOST IMPORTANT THING TO KNOW ABOUT FIELD SOBRIETY TESTS is that a skilled defense lawyer will know how to handle them in court and in order to better represent you, as a former prosecutor, P. David Wool has been trained in the theory and administration of Standardized Field Sobriety Tests by both the District Attorney's Office and actual training police officers at the police academy and also has completed advanced training which allowed him to become one of only a few such attorneys in Northern California. Government statistics indicate that each year more people die as a result of accidental drowning in America than die in low BAC related motor vehicle accidents. A recent study at a major U.S. university found that low BAC drinking drivers pose far less danger to public safety than do non-drinking drivers who have sleep apnea. In fact, your chances of being killed as a direct result of medical malpractice is 28 times higher than your chances of being killed in a motor vehicle accident involving a low BAC driver. Despite the extremely low statistical threat to public safety posed by low BAC drinking drivers, more than 600,000 low BAC drivers are arrested and convicted for "drunk driving" in America each year. Once arrested these otherwise law-abiding citizens are subjected to imprisonment; forced to pay huge fines and court costs; forced to pay the costs of probation; suffer unjust property forfeitures; forced to attend political re-education camps; subjected to psychological testing; forced to engage in involuntary forced labor; suffer government sponsored public humiliation; suffer the loss of driving privileges; suffer loss of respect for the courts and their government; suffer the loss of their jobs; their self esteem; and the destruction of their families. This unfortunate state of affairs has been foisted upon America by an anti-alcohol, political action organization known as Mothers Against Drunk Driving, (MADD).
