DUI Defense - Field Sobriety Testing - One Leg Stand Test DUI Defense DMV Hearings Field Sobriety Testing Walk & Turn Test One Leg Stand Test Horizontal Gaze Nystagmus Mature Driver One Leg Stand Test In order to perform this test, it must be performed on a hard, dry, level, non-slippery surface. Conditions must be such that the suspect would be in no danger if he or she were to fall. Certain wind/weather conditions obviously may interfere with and affect the validity of this test. This test should not be given to persons who are more than sixty-five years of age, more than fifty pounds overweight, or with physical impairments that interfere with balance. Individuals wearing heels more than two inches high should be given the opportunity to remove their shoes as this may diminish the reliability of the results. The officer is trained not to give this test if there is not adequate lighting to perform it. In total darkness, even the average, sober person may have difficulty with this test, due to their visual frame of reference being taken away. It is imperative that the officer observe the DWI suspect from at least three feet away, and remain as motionless as possible while the suspect is performing this test. If this is not done, the test may be interfered with and ultimately affect the results and validity. In the administration of this DUI test , there is also two separate stages involved. The first stage is also called the "Instruction" Stage. The test is initiated by giving verbal instructions, followed by and accompanied by demonstrations of those instructions. The officer is trained to advise the suspect to stand with their heels together and arms down at their sides. The officer must demonstrate this. The officer must also inform the suspect not to start the test until told to do so, and must receive an indication from the suspect that they understand the instructions so far and to document this acknowledgement. There are no scoring factors involved until the suspect is into the next stage which is called the Balance and Counting Stage, unless the suspect can not perform the test at all. This would give the suspect a maximum score of four points and would necessitate explanation on the part of the officer. The second stage, the "Balance and Counting" Stage, the officer is required to explain the test requirements further by instructing the suspect to stand on one leg, holding the other foot in front, while the officer demonstrates. The suspect should be allowed to stand on either leg that they wish. The suspect is instructed to keep the foot raised about six inches off the ground. The officer demonstrates this and should advise the suspect if it isn't to the officer's satisfaction. The suspect is further instructed that while they are standing, they will count out loud for 30 seconds, and the officer will demonstrate the count as "one-one thousandth, "two-one thousandth, etc., all the way to thirty-one thousandth. The suspect is told to look down at their foot while counting and throughout the entire test, to keep their arms at the sides at all times. They are told to refrain from hopping or swaying while standing. The suspect must again acknowledge that they understand the instruction to retain validity of the test. The test is then begun. A suspect may be scored a point for the following reasons. Suspect sways while balancing. The officer is trained not to be too critical in this scoring as the suspect is a living, breathing person, and some sway will be noticed as a result of this. The swaying that can be scored is a marked sway, such as a back-and-forth motion while the suspect maintains the one-leg-stand position. Ask yourself this: is it easier to balance yourself on one foot or two? The suspect uses the arms for balance in respect to having their arms six or more inches from the side of the body. Again it must be taken into account, the distance from the body that the suspect might normally start with, such as in the case of bodybuilders. If the suspect puts their foot down, regardless of how many times, they are only given one point on this scoring factor. The suspect should be allowed to continue from the point of difficulty as this test may lose sensitivity if repeated several times. The suspect has been instructed to keep watching their raised foot and to count out loud, but if they do not follow either of these instructions, they are not scored any points, as it is not a part of any scoring factor. Ask yourself this: why does a circus tightrope walker use that long pole? It is to allow herself to displace her weight over a larger area to make it easier to balance in an unnatural position If the suspect counts too slow it is imperative that the officer stop the test after thirty seconds have elapsed as this may affect the scoring and validity of the test. The officer is trained to time thirty seconds of total test time. If the suspect counts too fast the officer is instructed to slow them down. The last scoring factor in this test is when a suspect hops on one foot. This is scored only if they resort to hopping on the anchor foot in order to maintain balance. It should not be scored if the suspect is having difficulty by moving the anchor foot back and forth. The officer is supposed to be able to distinguish this as part of their training and to allow the suspect this benefit.Ask yourself this: when you feel you are about to fall, do you reflexively begin to hop to keep yourself from falling? Scoring the One Leg Stand The suspect can receive a maximum score on this test in two ways. This will happen if the suspect puts their foot down three or more times during the thirty second count, or otherwise demonstrates that they can not do the test. The officer must be able to articulate why they felt the defendant could not do this test. The degree of reliability attached to this test if it is demonstrated and scored properly is 65%. The officer is trained to use this as probable cause to arrest the suspect for DWI. For purposes of the arrest report and courtroom testimony, the officer is trained that it is not simply enough to report the suspect's "score" on the three tests. The numeric scores are only important to the police officer in the field to determine probable cause. It is insufficient to secure a conviction, and must be accompanied by more descriptive evidence. The officer is trained that they must be able to describe how the suspect performed, and exactly what the suspect did when he or she performed the test and when these clues occurred. The manual provided to the officer has a standard note-taking guide which should be utilized to assist the officer and prove the case. (For drivers under the age of 21, the limit is .02%.) Before political groups, such as MADD (http://www.madd.org) , took over the legislative process, to get a DUI conviction in Kentucky the government had to prove driver was "under the influence of alcohol." This type of case is pursued even if no alcohol content test result exists from a blood, breath or urine test . Most cases in which a suspected impaired driver refuses a chemical test of his or her blood, breath or urine are prosecuted as "under the influence" cases. Cases in which the driver does not test above the legal limit can be prosecuted as "under the influence" cases. Now, drunk driving cases can be brought even if there is no impairment to a person's driving, due to the per se laws. These laws criminalize driving based upon the "science" of blood or breath alcohol testing , and being above a certain level, even if there is nothing whatsoever wrong with the way the person is driving. Kentucky "repeat offender" status for DUI cases is determined based upon a five-year "lookback" period . This status is used for purposes of increased mandatory minimum punishment. This "lookback" period has nothing to do with how long a DUI remains on your record. For purposes of Kentucky law, the "lookback" period is calculated from arrest date to arrest date. top First offense Kentucky DUI Cases are punished as follows: Fine: $200.00-$500.00 (plus statutory service fee of $250.00 and other miscellaneous costs.) Jail: 48 hours to 30 days. Under Kentucky law for a first offender, either a fine or jail must be imposed. Community Service: In lieu of a fine or imprisonment or both, an offender can apply to the judge for permission to enter a community labor program for not less than 48 hours nor more than 30 days. License Suspension: For Kentucky residents 21 and over when arrested, a District Judge can impose a license suspension between 30 and 120 days. A hardship license is available if the suspension is more than 30 days. Drivers under 21 will be suspended for 30 days to six months and can have a hardship license. After the license suspension and completion of alcohol treatment , drivers may be reinstated. Alcohol and Drug Assessment and Treatment: Ninety days . Any non-Kentucky driver's home state licensing agency (DMV, DPS, etc.) will receive notice from the Kentucky Department of Transportation if any license suspension or case disposition (conviction or plea) occurs in Kentucky and the non-resident's license is involved. In almost all cases, a guilty plea or guilty verdict in a DUI in Kentucky will cause a suspension to occur in the non-resident's home state. A "not guilty" verdict or other non-DUI disposition of the case will prevent such consequences. These suspensions can be lengthier and reinstatement more onerous. This puts a premium on winning the case, or obtaining a non-DUI disposition. DUI Second Offense DUI Third Offense DUI Fourth Offense Drivers Under 21 top Aggravating Factors The new DUI law in Kentucky, effective October 1, 2000, establishes a list of six aggravating factors, which, if present, double the mandatory minimum jail sentence which must be imposed and which cannot be probated or conditionally discharged. Aggravating factors only act to enhance minimum jail sentences. Aggravating factors do not enhance fines, fees and license suspensions. The aggravating factors are: Operating a motor vehicle in excess of thirty (30) miles per hour above the speed limit; Operating a motor vehicle in the wrong direction on a limited access highway; Operating a motor vehicle that causes an accident resulting in death or serious physical injury; Operating a motor vehicle while the alcohol concentration in the operator's blood or breath is 0.18 or more as measured by a test or tests of a sample of the operator's blood or breath taken within two (2) hours of cessation of operation of the motor vehicle; Refusing to submit to any test of one's blood, breath or urine requested by an officer having reasonable grounds to believe the person was operating or in physical control of a motor vehicle in violation of the DUI laws; Operating a motor vehicle that is transporting a passenger under the age of twelve (12) years old. Mandatory minimum jail sentences for a DUI with an aggravating factor are: First Offense: Four days; Second Offense: 14 days; Third Offense: 60 days; and Fourth Offense: 240 days. The aggravating factors do not apply to under-21 DUIs. There is no prohibition on dismissal by the prosecution of the aggravated circumstance to avoid the minimum mandatory sentence. For a first offense, the aggravating factor must be present at the time of operation of the motor vehicle. This excludes imposition of the mandatory minimum jail sentence for refusals since refusals cannot occur at the time of operation of a motor vehicle. top "Refusal" Penalties If you are operating or in physical control of a motor vehicle anywhere in Kentucky you are deemed to have given your consent to one or more tests of your blood, breath, or urine for purposes of determining alcohol concentration. This is called the implied consent law. At the testing site, at the time a chemical test is requested, you shall be informed that: a refusal may be used against you in court as evidence and will result in revocation of your driver's license; if you refuse and are subsequently convicted of DUI you will be subject to a mandatory jail sentence which is twice as long as the mandatory jail sentence imposed if you submit to the tests; and if you refuse you will not be able to obtain a hardship license. If you submit to the requested tests, you have the right to a test or tests of your blood performed by a person of your choosing within a reasonable time and at your expense. You must be advised of this right and specifically asked, "Do you want such a test?" Remember you must submit to all requested police chemical tests, except a portable breath test, before you have the right to an independent test. Even if you are acquitted of the DUI at trial, the court shall impose the appropriate license suspension for refusing to submit to a chemical test. For a DUI first offense refusal, a driver's license shall be suspended for 30 days to 120 days. For a DUI second offense refusal, a driver's license shall be suspended for 12 months to 18 months. For a DUI third offense refusal, a driver's license shall be suspended for 24 months to 36 months. For a DUI fourth offense refusal, a driver's license shall be suspended for sixty (60) months. Right to a Lawyer Kentucky drunk driving law is unique in one key respect: If arrested for DUI, you now must be afforded an opportunity to attempt to contact a lawyer. The opportunity is for not less than ten minutes or more than 15 minutes during the observation period prior to a breath test or at the hospital prior to blood or urine testing. DUI FACTS - ILLINOIS IN 2003 / NATIONALLY / .08 BAC SERVICES PROGRAMS PRESS PUBLICATIONS DEPARTMENTS CONTACT DUI Facts - Illinois In 2003 / Nationally / .08 BAC In Illinois in 2003: 639 people were killed in alcohol-related crashes, which was 44 percent of the 1,453 total crash fatalities. More than 49,000 DUI arrests were recorded by the Secretary of State's office. 93 percent of all drivers arrested for DUI, who were eligible, lost their driving privileges. 2,863 drivers under age 21 lost their driving privileges due to "Use It & Lose It" law violations. 17 percent of those arrested for DUI are women, who represent 50 percent of all licensed drivers. Males ages 21-24 had the highest DUI arrest rate (27.6 per 1,000 licensed drivers). This rate was four times greater than that of all other drivers arrested for DUI (6 per 1,000). 83 percent of all drivers arrested for DUI are first offenders. Nationally: Alcohol-related crash fatalities totaled 17,013 in 2003. Alcohol-related occupant fatalities increased 3 percent in SUVs and 5 percent on motorcycles in 2003. 40 percent of crashes involving an alcohol-impaired or intoxicated driver or non-occupant resulted in an involved person being killed or injured. Drivers with a BAC greater than .08 who were killed in crashes were 10 times as likely to have a prior conviction for driving while intoxicated. About 275,000 people suffered injuries in alcohol-related crashes in 2003. More than 1.5 million drivers are arrested for driving under the influence of alcohol or other drugs each year. This represents one in every 130 drivers in the United States. The percentage of alcohol-related crashes in 2003 represents an average of one alcohol-related fatality every 31 minutes and one alcohol-related injury every two minutes. The rate of alcohol involvement in fatal crashes is three times as high at night as during the day. More than 53 percent of weekend evening crashes are alcohol related. Motor vehicle crashes are the leading cause of death for people ages 2-33. The highest intoxication rates for drivers in fatal crashes were recorded for drivers ages 21-24 (32 percent), followed by ages 25-34 (27 percent) and 35-44 (24 percent). Alcohol-related crashes, injuries and fatalities cost society more than $45 billion in lost productivity, medical care, property damage and other direct expenditures annually. Facts about .08: Illinois .08 BAC limit was signed into law July 2, 1997. .08 is a measurement of the blood-alcohol concentration level at which drivers are considered intoxicated and, therefore, are prohibited from driving on Illinois roadways. Illinois, 48 other states, the District of Columbia and Puerto Rico have .08 BAC per se laws. On Aug. 1, 2005, Minnesota will become the final state to enact the .08 per se law. At .08, all drivers are impaired to the point that critical driving skills are greatly diminished. Studies indicate that at a .08 BAC level, a drivers steering, braking, speed control, lane changing, gear changing and judgments of speed and distance are all significantly impaired. To reach .08, a 170-lb. male would have to consume four or more drinks in a one-hour period on an empty stomach. A 137-lb. female would have to consume three drinks in one hour to reach .08. A drink is considered a 12- oz. beer, a 5-oz. glass of wine or a cocktail containing 1.5 ounces of 80- proof liquor. At .08, a driver is three times more likely to be involved in a car crash than a sober driver, and 11 times more likely to be killed in a single-vehicle crash. Skeptics of .08 laws suggest that repeat offenders are the real problem with regard to drunk driving. However, about 80 percent of alcohol-related crash fatalities are caused by drivers with no arrests for drunk driving during the previous three years. On January 7, 2006 at approximately 10:30 a.m., a 1997 Ford Ranger pickup driven by SHANNON M. VANDERLINDE, age 37, from north Portland, was northbound on Stafford Road when it crossed the centerline. The left front headlight area of the Ford Ranger pickup crashed into the left front headlight area of a southbound 2001 Chevrolet Trailblazer driven by MAURENE GOODPASTURE, age 54, from Lake Oswego. GOODPASTURE was seriously injured and transported by LifeFlight to Oregon Health Sciences University. VANDERLINDE received minor injuries and was transported to Meridian Park Hospital where she was treated.
