Admendment to Driving Under Influence 55-10-401 ADMENDMENT: 55-10-401 [SEE COMPILER'S NOTES]Driving Under the Influence of Intoxicant, drug or drug producing stimulant prohibited - Alcohol Concentration in Blood or Breath. 55-10-401 (Amended Effective July 1, 2003.) Blood Alcohol Concentration is now .08 55-10-401. Driving under the influence of intoxicant, drug or drug producing stimulant prohibited - Alcohol concentration in blood or breath. (a) It is unlawful for any person to drive or to be in physical control of any automobile or other motor driven vehicle on any of the public roads and highways of the state, or on any streets or alleys, or while on the premises of any shopping center, trailer park or any apartment house complex, or any other premises which is generally frequented by the public at large, while: (1) Under the influence of any intoxicant, marijuana, narcotic drug, or drug producing stimulating effects on the central nervous system; or (2) [Amended effective July 1, 2003 to .08. See the Compiler's Notes.] The alcohol concentration in such a person's blood or breath is ten-hundredeths of one percent (.10%) or more. (b) For the purpose of this section, "drug producing stimulating effects on the central nervous system" includes the salts of barbituric acid, also known as malonyl urea, or any compound, derivatives, or mixtures thereof that may be used for producing hypnotic or somnifacient effects, and includes amphetamine, desoxyephedrine or compounds or mixtures thereof, including all derivatives of phenolethylamine or any of the salts thereof, except preparations intended for use in the nose and unfit for internal use. (2) Revoke the person's privilege to operate a motor vehicle for aperiod of two years if the refusal occurred within seven years ofeither (A) a separate violation of Section 23103 as specified inSection 23103.5, or of Section 23140, 23152, or 23153, or of Section191.5 or paragraph (3) of subdivision (c) of Section 192 of the PenalCode, that resulted in a conviction, or (B) a suspension orrevocation of the person's privilege to operate a motor vehiclepursuant to this section or Section 13353.2 for an offense whichoccurred on a separate occasion. (3) Revoke the person's privilege to operate a motor vehicle for aperiod of three years if the refusal occurred within seven years ofany of the following: (A) Two or more separate violations of Section 23103 as specifiedin Section 23103.5, or of Section 23140, 23152, or 23153, or ofSection 191.5 or paragraph (3) of subdivision (c) of Section 192 ofthe Penal Code, or any combination thereof, which resulted inconvictions. (B) Two or more suspensions or revocations of the person'sprivilege to operate a motor vehicle pursuant to this section orSection 13353.2 for offenses which occurred on separate occasions. (C) Any combination of two or more of those convictions oradministrative suspensions or revocations. The officer's sworn statement shall be submitted pursuant toSection 13380 on a form furnished or approved by the department. Thesuspension or revocation shall not become effective until 30 daysafter the giving of written notice thereof, or until the end of anystay of the suspension or revocation, as provided for in Section13558. (D) For purposes of this section, a conviction of any offense inany state, territory, or possession of the United States, theDistrict of Columbia, the Commonwealth of Puerto Rico, or Canadathat, if committed in this state, would be a violation of Section23103, as specified in Section 23103.5, or Section 23140, 23152, or23153, or Section 191.5 or paragraph (3) of subdivision (c) ofSection 192 of the Penal Code, is a conviction of that particularsection of the Vehicle or Penal Code. (b) The notice of the order of suspension or revocation under thissection shall be served on the person by a peace officer pursuant toSection 23612. The notice of the order of suspension or revocationshall be on a form provided by the department. If the notice of theorder of suspension or revocation has not been served by the peaceofficer pursuant to Section 23612, the department immediately shallnotify the person in writing of the action taken. The peace officerwho serves the notice, or the department, if applicable, also shallprovide, if the officer or department, as the case may be, determinesthat it is necessary to do so, the person with the appropriatenon-English notice developed pursuant to subdivision (d) of Section14100. (c) Upon receipt of the officer's sworn statement, the departmentshall review the record. For purposes of this section, the scope ofthe administrative review shall cover all of the following issues: (1) Whether the peace officer had reasonable cause to believe theperson had been driving a motor vehicle in violation of Section23140, 23152, or 23153. (2) Whether the person was placed under arrest. (3) Whether the person refused to submit to, or did not complete,the test or tests after being requested by a peace officer. (4) Whether, except for the persons described in subdivision (a)of Section 23612 who are incapable of refusing, the person had beentold that his or her driving privilege would be suspended or revokedif he or she refused to submit to, or did not complete, the test ortests. (d) The person may request an administrative hearing pursuant toSection 13558. Except as provided in subdivision (e) of Section13558, the request for an administrative hearing does not stay theorder of suspension or revocation.
