The expression "DUI" is not found in the CriminalCode of Canada. Canadians use terminology other than DUI or "driving underthe influence". In Brampton, Ontario we use the words "impaired driving" or"impaired operation", or "impaired care or control" but not "driving under the influence"or "driving under impairment". Every one commits an offence who operates a motorvehicle or vessel or operates or assists in the operation of an aircraft orof railway equipment or has the careor control of a motor vehicle, vessel, aircraft or railway equipment,whether it is in motion or not, (a) while the person's ability to operate the vehicle, vessel, aircraft or railway equipment is impaired by alcohol or a drug; or (b) having consumed alcohol in such a quantity that the concentration in theperson's blood exceeds eighty milligrams of alcohol in one hundred millilitresof blood. Impaired operation or care or control in Brampton, Canada includes operation or care orcontrol of a motor vehicle, vessel, or aircraft while one's ability to operateis impaired by alcohol or a drug to any degree of impairment. This DUI offence isproven by evidence of bad driving and various indicia of impairment observedsuch as slurred speech, difficulty with standing walking turning, red glassyglossy bloodshot eyes, dilated pupils, odor odour of an alcoholic beverage,complexion flushed face, and performance on physical tests. The DUI offence of excess blood alcohol or over 80 is usually proven by breathtests that determine blood alcohol concentration using and approved instrumentsuch as a Breathalyzer 900 900A or Intoxilyzer 5000C. Blood tests are used inDUI cases where breath testsare not practical to provide evidence of blood alcohol concentration. Both Canadian DUI offences are federal criminal law offences. The Court must impose mandatory license suspensions, fines, surcharges and in certain cases, jail. The Division of Motor Vehicles must also impose a mandatory insurance surcharge from $3,000 to $3,500. A permanent record of the DWI conviction is also entered on the Drivers Abstract maintained by the New Jersey Division of Motor Vehicles. Penalties differ depending upon whether the offense is a first, second or subsequent offense. We defend DWI charges every day in Courts throughout the State of New Jersey . Our philosophy is that you can not win a DWI case unless you try to win. For this reason, we try almost all of our cases to a verdict unless a better result can be achieved without trial. We make the State prove its case both in trial and in pre-trial suppression motions. We search for all possible evidence which might make the difference in winning a case. We vigorously cross-examine police officers regarding field sobriety tests and observations claimed to suggest intoxication. We work regularly with the top DWI expert in the State of New Jersey, who can attack breath test results and field sobriety test results when these tests have not been correctly administered. My practice is limited to defending drivers charged with Driving While Intoxicated and related offenses. I have been defending drivers charged with DWI over the past 26 years.
