Drunk DrivingNational Drunk and Drugged Driving Month -- National Center forInjury Prevention and Control 3D Month Impaired Driving Fact Sheet December is National Drunk and Drugged Driving Prevention Month Impaired driving will affect one in three Americans during their lifetime. In 2004, 16,694 people died in alcohol-related motor vehicle crashes, accounting for 39% of all traffic-related deaths in the United States (NHTSA 2005). December is National Drunk and Drugged Driving Prevention Month (3D Month) by Presidential Proclamation . Quick Facts About Drunk and Drugged Driving An alcohol-related motor vehicle crash kills someone every 31 minutes and nonfatally injures someone every two minutes (NHTSA 2005). Drugs other than alcohol (e.g., marijuana and cocaine) are involved in about 18% of motor vehicle driver deaths. These other drugs are generally used in combination with alcohol (Jones et al. 2003). Each year, alcohol-related crashes in the United States cost about $51 billion (Blincoe et al. 2002). Most drinking and driving episodes go undetected. In 2004, about 1.4 million drivers were arrested for driving under the influence of alcohol or narcotics (Department of Justice, 2005). Thats less than one percent of the 159 million self-reported episodes of alcoholimpaired driving among U.S. adults each year (Quinlan et al. 2005). To further decrease alcohol-related fatal crashes, communities need to implement and enforce strategies that are known to be effective, such as sobriety checkpoints, 0.08% BAC laws, minimum legal drinking age laws, "zero tolerance" laws for young drivers, and others (Elder et al. 2002, Howat et al. 2004, Shults et al. 2001, Shults et al. 2002). On January 7, 2006 at approximately 10:30 a.m., a 1997 Ford Ranger pickup driven by SHANNON M. VANDERLINDE, age 37, from north Portland, was northbound on Stafford Road when it crossed the centerline. The left front headlight area of the Ford Ranger pickup crashed into the left front headlight area of a southbound 2001 Chevrolet Trailblazer driven by MAURENE GOODPASTURE, age 54, from Lake Oswego. GOODPASTURE was seriously injured and transported by LifeFlight to Oregon Health Sciences University. VANDERLINDE received minor injuries and was transported to Meridian Park Hospital where she was treated. Upon release, an Oregon State Police trooper cited her for DUII, Assault Second Degree, Reckless Driving, and Possession of a Controlled Substance - Methamphetamine. Safety restraint use information was not available. Oregon State Police troopers and crash reconstructionists from the Portland and Tualatin offices are continuing the investigation. Field sobriety tests ("walk-the-line", Drunk Driving Breath Tests and Field Sobriety Tests Ventura County DUI Field Sobriety Tests and Breath Alcohol Tests DUI evidence falls into five categories: Blood-alcohol evidence - Usually a breath test but sometimes a blood test. (Urine tests are now given in California only when breath or blood are not available.) Personal symptoms (slurred speech, bloodshot eyes, etc.) Field sobriety tests ("walk-the-line", reciting the alphabet, etc.) Incriminating statements ("I only had six beers") Driving symptoms (weaving, lane straddling, etc.) Procedurally, you should be aware of certain legal rights you have rights which are commonly ignored by the police: There must be legally sufficient facts to constitute "probable cause" to stop, detain and arrest you. You should be advised that submission to field sobriety testing and portable field breath testing is not required by law. Once arrested, you must be advised of your constitutional rights the "Miranda" warning before any further questioning takes place. You must be given a choice of breath or blood testing; if you refuse, you must be advised of the legal consequences (the " implied consent " advisement). If a breath test is administered at the police station, since the breath sample is not saved, you must be given a chance to obtain a blood sample for later independent testing by your defense attorney. Includes the statistical probability that the specific type of driving involves intoxication (example: "Turning with a wide radius" indicates a 65% chance that the driver is intoxicated). The "Nystagmus" Test One of the most common field sobriety tests involves following a pen or finger with the eyes while keeping the head still. This is the " horizontal gaze nystagmus " test and although scientific in appearance, is highly unreliable due to the lack of expertise of the officer in administering or interpreting the test.
