OUIL attorneys defend those accused of Operating Under the Influence of Liquor ( OUIL ) is a drunk and impaired driving acronym for the state of Michigan. The other offenses for that state that pertain to driving under the influence of an intoxicant are "Zero Tolerance" which is for anyone under 21 years of age operating a vehicle with any bodily alcohol content (BAC), Operating a Vehicle While Impaired ( OWI ), Unlawful Blood Alcohol Level ( UBAL ), OUIL – Incapacitating Injury which means operating a vehicle under the influence of liquor causing an incapacitating injury (a felony offense), and OUIL – Death which means operating a vehicle under the influence of liquor causing a death (also a felony offense). Similar to other drunk driving offenses, a person is guilty of OUIL when he or she drives or is in actual physical control of a motor vehicle and is under the influence of alcoholic beverages or any chemical or controlled substance to the extent that his or her mental faculties are impaired or when his or her blood alcohol level (BAC) is above the legal limit for the state of Michigan. OUIL and other offenses involving the operation of a vehicle while intoxicated are criminal law matters, which could potentially incur a felony conviction and possibly a prison sentence, depending on how serious the charges are. Whether you are charged with a misdemeanor or felony offense, you should contact a OUIL lawyer immediately if you are arrested. New "Per Se" Offense Has Been Enacted In recent years, all 50 states and the District of Columbia have enacted a second, “per se”, offense: driving with an excessive blood-alcohol concentration (typically .08%). BOTH offenses are charged, and you can even be convicted of both. DMV Administrative Actions In addition to the criminal OUIL charges brought, your state's department of motor vehicles can also take a variety of administrative actions against you whether or not you are actually convicted. I actually showed up Monday and got picked for the trial Thursday morning. At first I thought there was no way I’d want a jury trial after hearing the people in the pool of prospective jurors, but after spending time with those people in the jury room I felt completely different. The actual trial was really short with only the police officer testifying, the video of the field sobriety test and the arrest. The lawyers doing their spin jobs, and the judge explaining the process and giving his instructions took the longest. The video that was shown was chopped, which led us to believe there was something they didn’t want us to see, which we then suspected were prior arrests. More on that later though. Other than the word of the police and the video, there wasn’t shit to go on as the defendant refused to take the breath/blood test and we were instructed that we couldn’t use that against him. Many of the things that were pointed out in the video such as him staggering, were in fact him rubbing out his cigarrete butt a few times. The smokers noticed that right away. Anyway we all thought there was more to the story that we weren’t being told, but it didn’t total up to being found guilty. When I got home the first thing I did was look up his arrest history that will show county and city arrests, and sure as shit this wasn’t his first incident. He had 3 previous arrests and two more after the fact. In all six he was booked for DUI, refusing to take the breath/blood test and for not having a licence. The limit in our state, sometimes ironically called the "legal limit," is .08%. The best advice any attorney can give you is don't drink and drive. Period. Imagine how many cab rides you can pay for with the money you'd spend on fines and attorneys' fees in a DUI case. So, let's say you've left the party thinking you're okay to drive only to have the flashing red and blues greet you. How to handle the DUI stop? First, stay in your car unless the officer asks you to step out and if you have your seat belt on, leave it on! Second, know these ten things: 1 - Provide identification. The officer will ask for your driver's license and registration. How easily you find these items will be noted on the officer's report. If you fumble around for them, it will look like you've had too much to drink. 2 - Politely refuse to take field tests. Field tests for DUI are: walking the line, touching your finger to your nose, counting on your fingers, saying your ABCs, holding your leg up while counting, and HGN, the one where the officer asks you to follow a light with your eyes. When you do field tests, you are giving evidence that will be used against you. There is no law requiring you to do the tests. Some officers will tell you they will take you to jail if you don't do the tests. Don't fall for it. They were going to take you to jail anyway. 3 - If asked, politely explain that you will not agree to a search of your car. If the officer has to ask you to agree, it's a red flag. Just say no. If an officer has enough reason to get a search warrant, he or she will. If not, then why search? Usually the question will come at you like: You don't mind if I look in your car, do you? You don't have a problem with my looking in your car? I'm just going to take a quick look inside, okay? Say no--politely, but firmly--and don't explain. And hope your no makes it into the report. 4 - Politely refuse to answer questions. Usually the officer will ask you a few questions about what you've had to drink and then move on to more questions later at the station. Your best response is: "I can only answer your questions on the advice of my attorney." You don't have to call an attorney right then. The statement effectively stops any questioning of you by invoking your constitutional rights. Even when the officer reads Miranda rights to you, the answer should be the same. 5 - Cooperate, cooperate, cooperate. Cooperation means having a good attitude and being polite. It doesn't mean answering questions or doing field tests or talking. Your attitude, appearance and words all become part of the officer's report. Your disposition indicates your level of intoxication. This is not the time to crack jokes, cry, apologize or confess. Iowa television stations find machines in bars deliver mixed results Nov 23, 2004 - Checks conducted by Iowa television stations call to question the accuracy of coin-operated machines used in bars to measure blood alcohol - or at least their accuracy compared to official breathalyzers. ADVERTISEMENT KWWL, Channel 7, enlisted the help of a news intern, and a local parole and his breathalyzer to see how the "Counselor Alcohol Breath Check" machines measured against equipment used by law officers. The intern downed his a pitcher of beer in 20 minutes, waited 10 minutes and took two tests. The "Counselor Alcohol Breath Check" showed a blood alcohol level of .02%. Officer Sam Black's breathalyzer indicated the level was .05%. After another pitcher of beer, the intern indicated he felt like he was over the legal limit for driving of .08%. The "Counselor Alcohol Breath Check" read only .06%, but the official breathalyzer showed .16%. The bar manager said she was surprised the machine's readings were so different from the breathalyzer. The person distributing the machines to the eastern Iowa bars said the machines need to be calibrated every other week, and this one was due for a checkup in one week. KCRG-TV9 in Iowa City also visisted local bars. Matt Schilling, drinking with his friends at R.T. Grunts in Iowa City, told a reporter he had several drinks over a few hours. He was surprised when he blew only .07. "I didn't think that was really that accurate," he said. He took one more drink of beer, took the test again, and registered .11%.
