JUDICIAL HEARINGS SERVICES PROGRAMS PRESS PUBLICATIONS DEPARTMENTS CONTACT Judicial Hearings A driver may request a judicial hearing to challenge a summary suspension within 90 days after the notice date. The hearing must be conducted within 30 days of the request or on the first court date scheduled to consider the criminal charges. Legally, only four issues may be considered: Whether the person was properly arrested; Whether there were reasonable grounds to believe at the time of arrest that the person was driving or in physical control of the vehicle while under the influence of alcohol or other drugs; Whether the driver, after being informed of the impending summary suspension, refused to submit to chemical testing; and Whether, after being advised of the summary suspension, the driver submitted to chemical testing that showed a BAC of .08 or greater or any trace of cannabis, a controlled substance and/or intoxicating compounds. The summary suspension is rescinded if the court rules in favor of the driver. The result of the hearing is entered on the driver's record. About 14 percent of the 49,569 Statutory Summary Suspensions processed in 2003 were rescinded, compared to 13 percent in 2002. Most states have "per se laws" that say it's a crime to drive with a blood alcohol concentration (BAC) at or above a certain level. Typically, license suspension or revocation follows a conviction for drunk driving. In addition, some states impose an administrative license suspension, where licenses are taken before conviction when a driver fails or refuses to take a chemical test. After a conviction, most states permit offenders to drive only if their vehicles have been equipped with ignition interlocks, which analyze a driver's breath and disable the ignition if alcohol is detected. Plus, many states force multiple offenders to forfeit the vehicles they were driving while impaired by alcohol. Drunk Driving LawDUI LAWS State Law Facts: (from the ) DUI/DWILAWS as of October 2000 Forty-ninestates (all except Massachusetts) and the District of Columbia have perse laws defining it as a crime to drive with a blood alcohol concentration(BAC) at or above a proscribed level, usually 0.10 percent. Licensesuspension or revocation traditionally follows conviction for alcohol-impaireddriving. Under a procedure called administrative license suspension, licensesare taken before conviction when a driver fails or refuses to take a chemicaltest. Because administrative license suspension laws are independent ofcriminal procedures and are invoked right after arrest, they've been foundto be more effective than traditional post-conviction sanctions. Forty-onestates and the District of Columbia have administrative license suspensionlaws. Forty-twostates permit some offenders to drive only if their vehicles have beenequipped with ignition interlocks. These devices analyze a driver's breathand disable the ignition if the driver has been drinking. In29 states, multiple offenders may forfeit vehicles that are driven whileimpaired by alcohol.
