Field sobriety tests ("walk-the-line", Drunk Driving Breath Tests and Field Sobriety Tests Riverside DUI Field Sobriety Tests and Breath Alcohol Tests DUI evidence falls into five categories: Blood-alcohol evidence - Usually a breath test but sometimes a blood test. (Urine tests are now given in California only when breath or blood are not available.) Incriminating statements ("I only had six beers") Field sobriety tests ("walk-the-line", reciting the alphabet, etc.) Personal symptoms (slurred speech, bloodshot eyes, etc.) Driving symptoms (weaving, lane straddling, etc.) Procedurally, you should be aware of certain legal rights you have rights which are commonly ignored by the police: There must be legally sufficient facts to constitute "probable cause" to stop, detain and arrest you. You should be advised that submission to field sobriety testing and portable field breath testing is not required by law. Once arrested, you must be advised of your constitutional rights the "Miranda" warning before any further questioning takes place. You must be given a choice of breath or blood testing; if you refuse, you must be advised of the legal consequences (the " implied consent " advisement). If a breath test is administered at the police station, since the breath sample is not saved, you must be given a chance to obtain a blood sample for later independent testing by your defense attorney. Officer's Guide to DUI Driving Symptoms Manual for officers setting forth the 20 types of driving to look for in detecting drunk drivers, from the U.S. Department of Transportation. Includes the statistical probability that the specific type of driving involves intoxication (example: "Turning with a wide radius" indicates a 65% chance that the driver is intoxicated). Field Sobriety Tests A description of the three so-called "standardized" field sobriety tests, developed by the National Highway Traffic Safety Administration the heel-to-toe, one-leg-stand and nystagmus tests. The "Nystagmus" Test One of the most common field sobriety tests involves following a pen or finger with the eyes while keeping the head still. This is the " horizontal gaze nystagmus " test and although scientific in appearance, is highly unreliable due to the lack of expertise of the officer in administering or interpreting the test. Intoxicated Driving Rob Gordon, Washington County (Oregon) Sheriff's Office -- Stopping Kids Intoxicated Driving (SKID) Washington County Sheriff's Office Stopping Kids Intoxicated Driving Rob Gordon, Sheriff 215 SW ADAMS, MS 32Hillsboro, OR 97123 Phone (503) 846-METH (6384) / FAX (503) 846-2733 What is a SKID? Stopping Kids Intoxicated Driving (SKID) is a program that brings what appears to be a fatal alcohol-related traffic crash to local high schools to illustrate the consequences of drunk driving. SKID is a graphic and realistic portrayal of crushed vehicles and injured bodies. As the scenario unfolds, Sheriff's Office deputies, state or local police officers, Metro West Ambulance, Life Flight and other public safety partners, converge on the scene. They actually go through the motions of administering first aid to the "victims". The dramatization is so realistic that people often get caught up in the emotions of the moment; they even forget that the scene is not real. Many students who witness a SKID are moved to tears. Because of the realism, a SKID presentation may not be suitable for children under 10 years of age. Deputy Tim Moore of the Sheriffs Office has been coordinating SKID presentations in local high schools since 1998. Since then, more than 30,000 students have witnessed the presentation. There have only been two alcohol-related crashes involving students from the schools that have seen the program. The crashes resulted in 1 death and 3 injuries. SKID is a very powerful tool in educating young people about the dangers of drinking and driving. The SKID presentations involve students from the high school hosting the event; they are made up to be crash victims. As a result, the SKID leaves a lasting impression in the hearts and minds of students and others that may face real-life decisions about drinking and driving. We strongly encourage parents, grandparents and friends to gather the teenagers in their lives and join us for one of these important events. Most states have "per se laws" that say it's a crime to drive with a blood alcohol concentration (BAC) at or above a certain level. Typically, license suspension or revocation follows a conviction for drunk driving. In addition, some states impose an administrative license suspension, where licenses are taken before conviction when a driver fails or refuses to take a chemical test. After a conviction, most states permit offenders to drive only if their vehicles have been equipped with ignition interlocks, which analyze a driver's breath and disable the ignition if alcohol is detected. Plus, many states force multiple offenders to forfeit the vehicles they were driving while impaired by alcohol. blood alcohol content of 312 Blood alcohol content 312 Blood alcohol content The blood alcohol content is measured in per cents or, as in Finland, in per mils. A blood alcohol content of 0.1% (i.e. 1) means that there is a gram of pure alcohol in a litre of blood. The alcohol content in other parts of the body, like the muscles and the brain, is the same. The alcohol content of fatty tissue is lower. The alcohol content of the blood is a practical way of measuring the amount of alcohol in the body. The blood alcohol content is also used as an indirect indicator of the level of intoxication, because the level of intoxication depends on the blood alcohol content. The alcoholic content of beverages is measured in percentages, either by volume or by weight. Percentage by volume indicates how many millilitres of pure alcohol there are per a decilitre of the beverage. Percentage by weight indicates how many grams of pure alcohol there are in 100 grams of the beverage. In addition to the amount of alcohol consumed, a person's weight and gender have an effect on the blood alcohol content. A big person will have a lower blood alcohol content than a small person. Women differ from men not only because of their average size, but also in the composition of the body. Women have more fatty tissue and less tissues that contain water than men. The body gets rid of alcohol by metabolizing it. The liver processes alcohol at an even speed. The metabolic process in the liver is the primary way for the body to get rid of alcohol, and there is little you can do to accelerate it. The rate of the process depends mainly on the size of the body, because the size of the liver is proportional to the size of the body. About a gram per each 10 kilos of body weight is processed in an hour. In per cents this means that, in an hour, the blood alcohol content decreases only by 0.012 - 0.016%. A normally built person who weighs 70 kilos metabolizes about 7 grams of alcohol in an hour, a person weighing 60 kilos only about 6 grams. In the morning after a night out you seldom stop to think that there may still be a good deal of alcohol in your body. The liver can metabolize a bottle of wine in approximately 12 hours; a bottle of spirits takes almost 24 hours.
