driving while intoxicated: a Criminal Defense Lawyer: Driving While Intoxicated CRIMINAL LAW INFORMATION Driving While Intoxicated • View sentence charts New York law prohibits operation of a motor vehicle while one's ability to doso is, to any extent, impaired by alcohol or drugs. A person is deemed intoxicatedwhen he has .08 percent or more by weight of alcohol in his blood, or upon thesubjective observations of a police officer (such as erratic driving, watery,bloodshot eyes, unsteadiness on feet). Operation means sitting behind the wheelof a motor vehicle when the vehicle is moving or the engine is running, withthe intent to move the vehicle. Operation can be proven by circumstantial evidencesuch as a person found unconscious or sleeping behind the wheel. Intoxication Tests There are three types of tests an officer will usually seek to perform on a personsuspected of driving while intoxicated: a field sobriety test, a screening test,and a chemical test. Field sobriety tests (finger-to-nose, one-leg stand, walkand turn, and gaze nystagmus) are premised on the fact that intoxication affectsphysical coordination and mental capacity. A screening test (Alco Sensor) isa portable breath test designed only to determine the presence of alcohol ina person's blood but not the concentration. Chemical tests (Breathalyzer, blood,urine) are designed to determine the percentage of alcohol in a person's blood.The Breathalyzer is by far the most common chemical test administered and hasbeen recognized by New York courts as scientifically reliable. Nevertheless,how a Breathalyzer test is administered, as well as the calibration and maintenanceof the Breathalyzer machine itself, can substantially affect the results. A chemical test must be administered within two hours of either the time of arrestor the time of a positive screening test, whichever is later. Althoughthe law does not require a suspect to submit to a field sobriety test, driversin New York are deemed to have given consent to screening and chemical tests.A driver may still refuse to take a chemical test but may face a mandatory licenserevocation for six months as a consequence. Drinking Driver Program Dispositions for drunk driving cases usually include participation in the NewYork State Drinking Driver Program. The program consists of a series of sevenclasses totaling a minimum of fifteen hours which are designed to deter futureviolations through education. The program provides the violator a conditionallicense to travel to and from work, school, medical exams, and other essentialactivities. Once a person has participated in the program, he may not do so againfor a period of five years. Vehicle Forfeiture In 1999, the New York City Police Department began commencing forfeiture actionsof the automobiles driven by people accused of driving while intoxicated. Thebasis of this policy is that the vehicle is the instrumentality of a crime andis, therefore, subject to forfeiture under the New York City Administrative Code.A forfeiture action is a civil lawsuit brought by the Police Department, andis a completely separate proceeding from the underlying criminal case which isprosecuted by the District Attorney. The New York City Police Department's ForfeitureInitiative has been upheld as constitutional despite challenges that the Initiativewas prohibited under state law, that forfeiture constituted an excessive fineand that forfeiture violated due process requirements for taking property. Additional consequences A DUI conviction is a permanent part of an offenders driving record. The offender may lose work time. The offender will be required to complete an alcohol and drug evaluation and an alcohol/drug remedial education course or substance abuse treatment program before his/her driving privileges are reinstated. The offender must meet the requirements of the Secretary of States Department of Administrative Hearings prior to obtaining a Restricted Driving Permit. The offenders vehicle may be impounded or seized. A Breath Alcohol Ignition Interlock Device (BAIID) may be installed in the offenders vehicle as a condition of driving relief. The offender is required to carry high-risk auto insurance for 36 consecutive months. The offenders vehicle registration will be suspended or revoked. The DUI criminal charge is prosecuted and adjudicated in the courts. This charge is separate from the Statutory Summary Suspension, which is an administrative process. A person convicted of DUI who lost his/her driving privilegesbecause of a summary suspension will have that time credited to the minimum driver's license revocation period. Full driving privileges are lost for a minimum of five years if a driver receives a second conviction for any of the following: DUI; leaving the scene of a personal injury or fatal crash; reckless homicide, or any combination of these offenses in a 20-year period. If a driver receives a third conviction for any of these offenses, regardless of the length of time between convictions, full driving privileges will be lost for a minimum of 10 years. If a driver receives a fourth or subsequent conviction, his/her license will be revoked permanently. If a driver is convicted of DUI in another state, Illinois driving privileges will be revoked. Of the driver's license revocations in 2003, 4,393 were for second offenses, 1,301 were for third offenses, and 734 were for fourth or subsequent offenses resulting in a lifetime revocation.
