Illinois Driver Illinois Drivers License With a Wisconsin DUI Case? Illinois Drivers Can Get Hammered Heres a scenario that Ive seen too many times. An Illinois driver gets arrested in Wisconsin for first offense DUI (or OWI in Wisconsin-speak). He asks the cop who arrested him what will happen to his Illinois license. The cop tells him that since he has an Illinois license, the Wisconsin case wont matter. The Illinois drivert then talks to a Wisconsin lawyer, who tells him that he needs to have an Illinois lawyer handle the Illinois consequences of the case or worse he tells the Illinois driver that the Wisconsin conviction wont matter in Illinois. The truth of the matter is, these answers are totally wrong. Sadly, this happens because some Wisconsin lawyers are willing to represent Illinois drivers, when they really dont understand how a Wisconsin case affects an Illinois drivers license. Its critical that an Illinois driver be properly represented in Wisconsin, or he will find himself being hammered by the Illinois Secretary of State. Heres why. The Wisconsin system and the Illinois system are very different and they dont match up with each other. Illinois imposes severe penalties for a Wisconsin first offense case. So, a Wisconsin case is far worse for an Illinois driver than an Illinois case. The Illinois System In Illinois, a person who is charged with first offense DUI routinely gets a plea-bargain. This may be a reduction of the charge or "court supervision." Court supervision is a deal in which the defendants drivers license is suspended for few months, hes ordered to go to some classes and if he does those things successfully, the case is dismissed. There is no DUI conviction on his record in this scenario. 1 Also, he can have a work permit (called a Restricted Driving Permit, or RDP, in Illinois) to drive during the suspension. So, by the time an Illinois person gets his first official DUI conviction he will have had at least one and possibly two or more prior DUI arrests. This is why the Illinois drivers license consequences for a first conviction are quite severe. Specifically, the first consequence is a drivers license revocation of an indefinite period of one year to life. That is, the Illinois driver can apply for reinstatement after one year, but he may not get it. In fact it often takes three to five years to get a reinstatement. During the revocation period, he may be able to get an RDP (restricted driving permit) that allows minimal driving for work, but it can be difficult. To get an RDP, there is a mandatory six-week waiting period before application, and the application are often deferred or denied. Plus, there are counseling and other requirements. It is not unusual for it to take six months to a year to obtain an RDP. In Illinois, therefore, its important to remember that the first DUI conviction is almost never the first DUI arrest. The Wisconsin System The Wisconsin system is very different. First and foremost, plea-bargaining in a Wisconsin DUI case is very rare. That is, it is extremely unusual for a DUI charge in Wisconsin to be reduced to a lesser charge. Also, there is no system of "court supervision" in Wisconsin. So, in Wisconsin, a defendants first DUI conviction will almost always be his first DUI arrest (unless he fights the case and wins, as do a good number of my clients). The practical consequence to a Wisconsin driver, however, is very similar to that of Illinois court supervision. The Wisconsin penalty is a six to nine month loss of drivers license with immediate automatic eligibility for a work permit (called an occupational permit in Wisconsin). There is also a fine to pay and an "assessment" or mandatory counseling. Unfortunately, many an Illinois driver has left a Wisconsin courtroom, having heard the Wisconsin judge impose the Wisconsin penalty, and believed that was the penalty he received for the Wisconsin case. Howeverand this is extremely significant--the Wisconsin penalty applies only inside the borders of the State of Wisconsin. A Wisconsin court cannot revoke an Illinois drivers license; it can only revoke the right to use that license in Wisconsin. Technically, the Illinois driver with a Wisconsin DUI revocation still has a valid Illinois license that can be used anywhere but Wisconsin, until and unless the Illinois Secretary of State says otherwise. This may seem like a big loophole, but actually this is what leads to the problem of the Illinois driver being hammered. To close this loophole, Wisconsin, like all states, will report the conviction to the "home" state, in this case Illinois. Then, Illinois will issue a reciprocal revocation order. It takes about a month, but the Illinois driver with a Wisconsin conviction is sure to get a letter from the Illinois Secretary of State revoking his drivers license. But, you see, Illinois treats an out-of-state Wisconsin conviction as though it were an in-state Illinois conviction . So, even though the Wisconsin case resulted from the first DUI arrest, it is treated the same as a second or third arrest in Illinois. The Illinois authorities will issue an indefinite revocation order of one year to life, with limited and discretionary eligibility for an RDP. There Is Still Hope If you are an Illinois driver with a Wisconsin first offense DUI case, it is critical that you get a Wisconsin lawyer familiar with the Illinois-Wisconsin problem. There are a number of strategies that may work to soften the blow to an Illinois driver. These sometimes involve using the Wisconsin refusal laws or even changing residency to the State of Wisconsin. CVU Press Conference on DUII Bills CVU Press Conference on DUII Bills CRIME VICTIMS UNITED CVU Joins With Legislators and Advocates To Combat DUII On Tuesday, February 27, 2003, Crime Victims United held a press conference in the Capitol Building to introduce a group of bills aimed at reducing injuries and deaths caused by intoxicated drivers. HB 2900 (LC 2444-1) Sponsored by Representative Randy Miller Refusal of the Breathalyzer test. In 2001 there were 3257 people that refused the breath test in Oregon. (Source: Oregon State Police) There were 25,097 DUII offenses in the year 2001 in our state. (Source: Oregon State Police) Penalty for refusal right now is a one-year suspension of driving privileges. There are no fines. The new law would require a fine of $500 to $1000. Nine states now impose a fine that ranges from $100 to $50,000 for refusal of the breath test. HB 2901 (LC 2443) Sponsored by Representative Randy Miller Acknowledgement of the risks of impaired driving. This bill requires drivers to sign an acknowledgement of risks when they apply for or renew a driver's license and when they register an automobile. Although everyone now knows that driving under the influence is potentially lethal and irresponsible, many people still do it. Some do it on a regular basis. Some DUII offenders go into court and claim that they didnt know the risks. This bill requires that all drivers explicitly acknowledge the risk of serious injury or death for others and the risk of prolonged imprisonment for themselves. The average alcohol related fatality in Oregon costs society $3.5 million, $1.3 million in monetary cost and $2.2 million in quality of life losses according to the National Highway Traffic Safety Administration. Including this message on license and registration applications in the state of Oregon will send an important and needed message. MADD supports this legislative concept. SB 421 Sponsored by Senator Tony Corcoran and Senator John Minnis Raise the crime of criminally negligent homicide to category 9 on the sentencing guidelines crime seriousness scale. Currently in Oregon, a person convicted of criminally negligent homicide who has no prior juvenile felonies or adult misdemeanors would normally be sentenced to 16 to 18 months in prison. This bill would raise the presumptive sentence to 34 to 36 months for taking a persons life. Alcohol related crash deaths are one of the most often committed violent crimes in Oregon. MADD supports an increase in sanctions for criminally negligent homicide, including raising the crime from level 8 to level 9 on the sentencing guidelines grid. SB 732 (LC 2530) Sponsored by Senator John Minnis Mandates impoundment of vehicle upon conviction of driving while suspended or revoked. Specifies minimum lengths of impoundment. Many people who are convicted of driving under the influence, and whose driving privileges are suspended or revoked, drive anyway. At the present time, the sanctions for driving while suspended are an indeterminate impoundment of the vehicle driven and a fine of $250 to $500. There were 57,000 convictions posted in 2001 for driving while suspended or revoked. (Source: Oregon Department of Motor Vehicles) San Francisco, California safety officials credit their 30 day impoundment law with a 63% drop in alcohol related fatal and injury crashes. LC 2879 Sponsored by Representative Jeff Barker Amends current statute so that upon the third conviction for misdemeanor driving under the influence of intoxicants, an offender loses driving privileges permanently. Under current Oregon statute, this loss of privileges may be appealed after 10 years. Currently Oregon law states that the first three convictions of driving under the influence of intoxicants are Class A misdemeanors, only becoming a Class C felony on the fourth conviction. Thus, not until a fourth conviction for DUII do offenders lose their driving privileges. The oldest was 91. Deseret Morning News graphic In between were 14,500 others, state officials told lawmakers in their first DUI report to the Utah Legislature. That number was a few hundred less than in the previous year, but none of the state officials there were celebrating the decrease in the number of people arrested driving impaired. With the focus on the 2002 Winter Olympic Games and cuts in the amount of money spent for DUI police patrols and programs, the drunken drivers were out there, just not being caught, said Susan Burke, head of the Commission on Criminal and Juvenile Justice, which shepherds DUI concerns in Utah. "There was no appropriation for special DUI enforcement in 2002," Burke told the group. Anna Kay Waddoups, an advocate for more stringent DUI sanctions, urged Transportation Interim Committee members to give more money to the programs that pay for DUI police patrols, computers in troopers' cars and DUI sting efforts when they meet in a special session later this month. "It's critical that those funds be allocated," she said. The data issue that has prevented an accurate accounting of a drunken driver's arrests, convictions and court sanctions is improving but is still a challenge, Burke said. It's critical to solving some of the most pressing DUI problems, she said. "But it's been no small feat to put together the data process." Justice court officials are having to be trained. Some are already, but that tier of the justice system still has a way to go, she said. The annual report was ordered by legislation last year, when lawmakers expressed frustration to the state courts and others for a lack of progress on DUI issues. While Utah's rate of alcohol-related fatal accidents remains the lowest in the nation, DUI arrests and deaths have been on the rise, and several high-profile DUI deaths brought the topic of repeat DUI offenders in the spotlight. The study found that while Utah law says judges shall order two days of jail or 48 hours of community service or electronic home confinement, judges were ordering jail time in about half of the cases. The law also states first-time DUI offenders shall pay a $700 fine, but preliminary data from a University of Utah study showed courts imposed fines in only about 60 percent of the cases. The report included the following recommendations: • Lawmakers need to pass appropriate language to distribute the 2003 alcohol funds to municipalities and counties to enhance DUI enforcement, prevention and treatment efforts. • Law-enforcement officers need continued training on how to respond appropriately during traffic stops. • Ongoing training for judges and prosecutors to ensure they are current with DUI laws. "Training should emphasize the effectiveness of various sanctions," the report said, "in particular the effectiveness of education and treatment in reducing repeat DUI offenses." • Alcohol education and treatment need to be emphasized as an effective and cost-effective sanction for DUI offenders. The U.'s study showed alcohol education is one of the most effective ways to regulate DUI, but Utah judges required treatment only 26 percent of the time for first-time offenders. First-timers who went to treatment were less likely to reoffend, the research showed. "Those not referred to treatment were much more likely to become two-time and multiple offenders," the report said.
